T 1 14,E '41, <br /> ' + member of the public; there being none, he entertained a Motion <br /> A?' �r regarding Attorney Butler' s request for continuance. <br /> ki <br /> MOTION: Martine Meijering made a Motion to continue Public <br /> Hearing in this matter to Wednesday, December 4, 1996, at 7: 00 <br /> 0 } � h p.m. ; which Motion was seconded by Patrick Coffey and so voted <br /> unanimously. <br /> a � ,, (The Public Hearing-Windchime Point matter concluded at <br /> 7:27 p.m. - The Chairman requested any casual Windchime Point <br /> discussion be moved out beyond the Meeting Room at this point. ) <br /> Correspondence <br /> William Henry-Boxberry Estates-Drainage Issue <br /> p� � M The Chairman determined there was no representation of Mr. <br /> William Henry present at the Meeting. He introduced a letter <br /> oil dated September 16, 1996, regarding Boxberry Estates, received <br /> e from William Henry, addressed to the Mashpee Planning Board: <br /> "Lot 19-Boxberry Estates-When I purchased the property in 1985, <br /> r`� ir" I was informed by the owner, Richardson-Jonas, that there was <br /> an easement on the property for the road drains, and on the <br /> property there are two clean-out basins. In a conversation with <br /> t , Mr. Fudala on Monday, September 16th, I explained that recently <br /> ,11 during rainstorms water comes out of the holes in the covers like <br /> fountains. This water then rushes down the hill and the road to <br /> ° • " the land. Having no prior knowledge of how this drain and <br /> leaching system was installed, I can only surmise that either it <br /> was clogged or was improperly installed. Mr. Fudala checked the <br /> j plans and informed me that there should have been three (3) <br /> clean-out basins on the property. One is missing. I realize <br /> � i . Rachel Court is a private road and not the direct responsibility <br /> of the Town. There are only three active homes on the Court and I <br /> do not feel the onus should fall on my shoulders to correct this <br /> situation. I am appealing to the Board for direction and advice <br /> 1 <br /> in order to resolve this situation. I have repeatedly attempted <br /> P Y P <br /> to alleviate the condition, but each time a rainstorm has wiped <br /> out my efforts. I am a retiree with limited resources. I built <br /> my home in Mashpee in 1988 and am proud to be living here. I <br /> v, ,5 wish to thank the Board for any consideration given to this <br /> situation.
