MA 02649 / <br /> BOARD OF APPEALS BV A v 6Q Z (:t,._ ALM <br /> AMENDED DECISION - 3. <br /> RE: James Circle Realty Trust V-91-1 - V-91-16 <br /> On June 24, 1992 the Board of Appeals held a public meeting <br /> at the Mashpee Town Hall during which time the Board was informed <br /> that the original Decision on James Circle Realty Trust, filed with <br /> the Town Clerk on January 24, 1992, should have included Variance <br /> relief for side-line setbacks to allow for 15' setbacks on Lots <br /> 1 through 16 due to the fact that the original Decision allowed <br /> for non-conforming lot size and frontage. <br /> The Board found that a literal enforcement of the provisions <br /> of the By-laws would involve substantial hardship and that relief <br /> may be granted without derogating from the intent or purpose of the <br /> by-laws. <br /> Mr. Friel moved to allow for 15' side-line setbacks. Ms. <br /> Hawver seconded. Mr. Mindick made the vote unanimous. The Variance <br /> relief applies to Lots 1 through 16 listed on the 1992 Assessor's Maps <br /> as Map 71, Blocks 168, 169, 170, 172, 173, 174, 175, 176, 177, 178, <br /> 179, 180, 181, 182, 183 and 184. <br /> BY: <br /> MASHPEE BOARD OF APPEALS <br /> IN FAVOR: <br /> J n J.
