LONA <br /> Tobin of Alaobpee <br /> %• 16 GREAT NECK ROAD NORTH <br /> MASHPEE, MA 02649 <br /> T BOARD OF APPEALS <br /> DECISION <br /> FOR A SPECIAL PERMIT <br /> RE: Cherrystones Inc. for a Special Permit SP-92-71 <br /> A Petition was filed by Cherrystones, Inc. for a Special Permit <br /> under Section 174-25.E.2 for permission to construct a restaurant in <br /> a C-2 zoning district on property located at 375 Nathan Ellis <br /> Highway (Map 72, Block 57B) Mashpee, MA. (Owner of record: Gerald <br /> F. Labute) . <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee, <br /> on September 25 and October 2, 1992, a copy of which is attached hereto <br /> and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town Hall <br /> on Wednesday, October 14, 1992 and continued on Wednesday, November 18, <br /> 1992 at which times the following members of the Board of Appeals were <br /> present and acting throughout: John J. Friel, Michael A. Makunas and <br /> Edward M. Govoni. <br /> Attorney Kevin Kirrane represented the applicant and presented <br /> plans for a restaurant with 34 parking spaces. Comments were received <br /> from abutters in favor of the application. At the November 18, 1992 <br /> meeting Mr. Kirrane and Engineer John Slavinsky presented revised <br /> plans based on recommendations of the Design Review Committee. <br /> Upon motion duly made and seconded the Board of Appeals voted <br /> unanimously on November 18, 1992 to grant the Special Permit. The <br /> Permit is referenced by Plan 63092 from Cape & Islands Engineering <br /> and is conditioned by the requirement that the applicant post a <br /> landscape bond in an amount to be determined by a review of two <br /> landscape proposals by the Design Review Committee. <br />
