MA 02649 <br /> Board of Appeals <br /> Decision for, a Variance <br /> RE: James Circle Realty Trust V-91-1 - V-91-16 <br /> A petition was filed by James Circle Realty Trust and <br /> 151 John' s pond Realty Trust of Hyannis, Massachusetts for, a <br /> Variance under, Section 174-31 of the Zoning By-laws for, <br /> permission to vary the minimum lot size and minimum lot <br /> frontage r•equir•ements on pr•oper•ty consisting of 16 lots <br /> located in an R-5 zoning district on James Circle (Map 71 , <br /> Blocks 151) - 163) Mashpee, Massachusetts. (Owners of r•ecor•d: <br /> Richard M. Scudder, TR, Joseph M. DeMar•tino, TR and Stage <br /> Development Inc. ) <br /> Notice was duly given to abutters in accordance with <br /> Massachusetts General Laws Chapter 40A. Notice was given by <br /> publication in The Enter•pr•ise, a newspaper, of general <br /> circulation in the Town of Mashpee on December, 21 and <br /> December 28, 1990, a copy of which is attached hereto and <br /> made a part hereof. <br /> A public hearing was held on the petition at the Mashpee <br /> Town Hall on Wednesday, January 9, 1991 at 7: .30 P. M. at which <br /> time the following members of the Board of Appeals were <br /> present and acting throughout: Cheryl A. Hawver•, William J. <br /> Hanrahan and B. Thomas Christian. <br /> Attorney Robert Mills r-epresented the applicants. He <br /> explained that they were seeking variances on 16 lots for, lot <br /> size and 14 lots for- lot frontage. He stated that all of the <br /> .lots ar-e larger, than those in the immediate area. He <br /> informed the Board that the owners had purchased the land <br /> without knowing the proposed subdivision plans were illegal <br /> and invalid. He said the land would be sold as lots and that <br /> the owners had no plans -For, development. <br /> Michael For•de, president of the John' s pond Estates <br /> Association, said that the plans were mutually agreeable to <br /> the Association and the owners, and that some of the land <br /> (parcel A) would be deeded to the Association for, <br />' r•ecr•eational use. <br /> I <br /> Elias McQuaid, Board of Health Agent, informed the Board <br /> that the illegal dumping at the site had been cor•r•ected to <br /> the satisfaction of the Board of Health. He said that the <br /> Board of Health is r•equir•ing that all of the lots be serviced <br /> by public water-. <br />
