MA 02649 <br /> BOARD OF APPEALS <br /> DECISION <br /> FOR A VARIANCE <br /> RE: Ronald McCarthy for a Variance - V-91-57 <br /> A Petition was filed by Ronald McCarthy of Westwood, Massachusetts <br /> for a :Variance from Section 174-31 of the Zoning By-laws for permission <br /> to vary the set-back requirements in an R-3 zoning district on property <br /> located at 7 Popponesset Island Road (Map 105, Block 261) Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts <br /> General Laws Chapter 40A. Notice was given by publication in The <br /> Enterprise, a newspaper of general circulation in the Town of Mashpee <br /> on October 4 and October 11, 1991, a copy of which is attached hereto <br /> and made a part hereof. <br /> A Public Hearing was held on the Petition at the Mashpee Town <br /> Hall on Wednesday, October 23, 1991 and continued to December 11, 1991 <br /> at which times the following members of the Board of Appeals were <br /> present and acting throughout: William J. Hanrahan, Michael A. <br /> Makunas and Cheryl A. Hawver. <br /> Attorney Kevin M. Kirrane and Engineer David Sanicki represented] <br /> the Applicant. Mr. Kirrane presented plans for a proposed pool and <br /> relocation of driveway. He explained that the topography of the lot <br /> prevented placement of the pool in any other location. The Board <br /> recommended a reduction in the size of the pool. Revised plans were <br /> presented to the Board on January 22, 1992 reducing the size of the <br /> pool and placing it 14' from Popponesset Island Road. The Board <br /> received a letter from Dr. Andrew E. Spognardi citing the medical <br /> need for a pool. <br />
