Board of Appeals Ronald McCarthy V-91-57 2. <br /> Comments were received from abutters and neighbors in favor <br /> t of, and opposed to, the Petition. <br /> Upon motion duly made and seconded the Board of Appeals <br /> voted unanimously on January 22, 1992 to grant the Variance <br /> allowing for a 14' set-back from Popponesset Island Road. The <br /> Variance is referenced by Plan 81291 of Cape & Islands Surveying Inc. <br /> revised 12/17/91. <br /> The Board of Appeals made the following findings: <br /> 1. because of the shape and topography of the lot it <br /> would be impossible to locate the swimming pool <br /> without a Variance <br /> 2. there would be hardship involved for the petitioner <br /> because of his medical need <br /> 3. a number of properties in the locale have pools <br /> on similarly sized lots <br /> 4. the revised plans require a variance of 1' or less <br /> which the Board finds diminimus <br /> 5. the Board determined that relief could be granted <br /> without nullifying or derogating from the intent or <br /> purpose of the By-laws and without detriment to the <br /> public good. <br /> 1 <br />
