The request of the Board is for a motion in granting the $5,000 <br />fee and waiver requirements prior to closing the Public Hearing. <br />MOTION: <br />Ms. Waygan made a motion to waive the $5,000 peer review fee. Mr. Balzarini seconded. All in <br />favor. <br />MOTION: <br />Ms. Waygan made a motion to waive the requirement from the application Special Permit <br />Regulations of form and content, subsections 3-21. Seconded by Mr. Balzarini. All in favor. <br />Ms. Waygan stated under draft decision it says 37 seats. <br />Mr. Lehrer noted the request is for 35 seats and that may be an error on his part, he will make the <br />correction. <br />Chairman Fulone would like to close the Public Hearing. <br />MOTION: <br />Mr. Balzarini made a motion to close the Public Hearing. Seconded by Ms. Waygan. All in favor. <br />Mr. Lehrer noted that the license for any outdoor music would fall under the Select Board. <br />MOTION: <br />Ms. Waygan made a motion to approve the application with the two approved waivers and the <br />following conditions: there shall be designated parking for pick up/take out and the applicant <br />has agreed to not apply for an entertainment license or live music. Seconded by Mr. Balzarini. <br />All in favor. <br />7:20P.M. <br />Applicant: Marcello Mallegni, Forestdale Road, LLC <br />Location: 523 Main Street (Map 26, Block 6) <br />Request: The applicant requests consideration for approval of a 9 lot <br />definitive subdivision plan of land consisting of approximately <br />18.05 acres located on Main Street (Route 130) between <br />Nicoletta's Way and Echo Road. <br />Ms. Waygan would like to state for the record she knows Mr. Healy through her job with the Town of <br />Yarmouth.
