:1 <br />t <br />Town ot Mashpee Aanning Board <br />16 Great Neck RoadWorth <br />wlashyee, wlassachusetts o2649 <br />MOTION: <br />Mr. Balzarini made a motion to set a Public Hearing for April 6, 2022 at 7:30p.m. for petition <br />zoning articles. Seconded by Ms. Waygan. <br />Request for release of covenant — 45 Fox Hill Road, Mashpee, Ma 02649 — Conaument Highlands <br />Mr. Lehrer noted this Board has reviewed a number of requests for release of covenants for this <br />subdivision. The developer in the early 70's carved out the roads, put covenants, got the subdivision <br />approved, sold lots and left town. Most of the homes are built out and streets have been improved and <br />are consistent with subdivision rules. This lot is also consistent and there are two remaining streets that <br />require intervention. The lot in question is completely built out and has not been released because <br />there was no development. The lot is 11,000 s.f. in Zone 2, so it can only have a one bedroom house. <br />They are selling the property, the covenant is still attached, and in order to convey the Board needs to <br />release the covenant. He would recommend releasing the covenant at Fox Hill Road. <br />Ms. Waygan asked if anything else was pending. <br />Mr. Lehrer commented just a request from the attorney and completion of the roads. The town has <br />been dealing with this subdivision lot by lot. <br />MOTION: <br />Mr. Balzarini made a motion to release the covenant for 45 Fox Hill Road. Seconded by Mr. <br />Callahan. All in favor. <br />CHAIRMANS REPORT <br />APCC FOCUS Article <br />Chairman noted Andrew Gottlieb's FOCUS article succinctly got to the point. He will send the PDF to <br />Mr. Lehrer who will disseminate to the Board. <br />Mr. Lehrer commented they are getting ready to roll out a series of maps. There doesn't need to be a <br />fight over every piece of land for development. There is an exercise to map what will and will not be <br />suitable. <br />TOWN PLANNER REPORT <br />LCP Update <br />Mr. Lehrer reminded the Board to look out for an E-mail from him within the week regarding the <br />website. <br />Revival of the Open Space Committee <br />He did provide a memo for the reestablishment of the Open Space Committee He used the word "only", <br />which had the perceived interpretation to mean only this committee can recommend. He is proposing to <br />eliminate the use of the word "only" as it could be anybody. He just meant staff should not be <br />unilaterally enabled to commence negotiations. <br />4 <br />
