Applicant: Paul and Ann Reon <br /> Location: 136 Captains Row, Pirates Cove <br /> Request: Signature of application. <br /> Louise stated that the shellfish warden did not have a <br /> problem with this , <br /> The Board made the same comments on this application, <br /> concern for shellfish habitat and need for further <br /> information to determine impact on navigability. <br /> Special Permit <br /> Applicant: Malcolm MacDonald <br /> Location: Back Road <br /> Request : Continuation of discussion of water Quality and <br /> Special Permit drafts . <br /> Attorney John Connely was present representing the <br /> applicant. He had received and reviewed a draft of the <br /> Special Permit. <br /> He stated that outstanding issues were: <br /> A. finalize easement language for water quality monitoring <br /> easement. <br /> B. Back Road issue. He had with Mike McGrath and Lee Weller <br /> to come up with a mediated resolution of Back Road. He <br /> presented a letter to the Board from Mr. McGrath. The <br /> Board's concern is about the deterioration of the road. In <br /> their opinion the trailer park traffic occurs prior to where <br /> the damage is. Mr. McGrath's letter stated that the damage <br /> is not necessarily ascribed to the traffic but rather it is <br /> an example of inadequate construction of the roadway 20 years <br /> ago. The problem is the base of the road, deterioration of <br /> the road bed. The letter explained how the road needs to be <br /> re-done. <br /> Mr. Connely stated that the applicant still believes the <br /> deterioration of the road is from use over many years and is <br /> caused by Town traffic and use as a public way. The 9 lot <br /> subdivision will not contribute significantly to the damage <br /> but they recognize an obligation to do something to the <br /> road. They suggest that, since the road bed needs to be <br /> re-done. the Town be responsible for sub service <br /> restructuring of the road and Dr. MacDonald will share in <br /> the cost of putting down the topping of the road. They <br /> hopes the Board agrees this is a reasonable alternative. <br /> They suggest repairs from the top of the road to entrance of <br /> the subdivision. <br /> Louise stated that she thought the issue was whether this <br /> road was a safe access for a subdivision? <br /> Judy stated that she does not know if the Planning Board has <br /> the right to tell another department where to send their <br /> resources and she thinks re-doing the sub surface will be <br /> most costly part of project. <br /> Mr. Connely stated that it is Mr. McGrath ' s opinion there i s <br /> no question that the road, as is , is adequate for a 9 lot <br /> 2 w <br />
