9. <br /> Pat stated that he wants to see the performance guarantee happen <br /> fast. It could take a few months to discuss what is done and not <br /> done. He would like to see the performance guarantee now. <br /> Mr. welch stated that his quick response to that would be that <br /> legally they are entitled to determine what is lef t to do and what <br /> the cost is before they establish the account. They would like to <br /> take a good look at it and review it with counsel . <br /> Mr. welch stated that they intend to be back with a response sooner <br /> than 45 days . <br /> Will be back on the Sept. 5th meeting. <br /> Charlie stated that he has a letter from Mr. Hostetter outling work <br /> which has been done but it is not requesting a reduction in the <br /> account. May be work which has been completed since then and some <br /> work listed may not have been done. <br /> The new list could be a combination from contractors and engineers . <br /> Mr, Baker stated that the sewage treamtment facility is one of the <br /> biggest items on the list, how do you quantify it when you don' t <br /> know what DEP current position is on the whole issue? What are the <br /> requirements for the sewage treatment facility 1990 vs 1987 <br /> requirement. <br /> Judy stated that the Board is looking for the treatment plant which <br /> was permitted under the special permit, encompassing the entire <br /> project. What DEP says later will have to be discussed at that <br /> t ime. <br /> Pat stated that the Board has released the last lot they will <br /> without sewage treatment. <br /> Mr. Baker asked how many lots have been released. <br /> original release was 52 and an additional amount of approxmiatly 12 <br /> were released. Tom will research to find exact amount. <br /> A member of the public asked if the restriction on the lot releases <br /> is also on the condo units? <br /> Tom stated that condos do not require a release. <br /> Can transfer title to the condos . <br /> Tom stated that the Seger Commission wants to talk about the torn <br /> operating the plant . <br /> Mr. welch will attend the Sewer commission meeting on Sept. llth. <br /> Judy stated that it is the Town' s primary concern to secure the <br /> bond. <br /> ANR -- Nate Ellis water District: <br /> Judy Mills stepped down. <br /> Mr . Ellis returned with a copy of the plan. He explained the site <br /> to the Board which is on Back Road. <br /> The ANR is for a storage tank. <br />
