Mr. Butler explained that under the zoning bylaw there is a <br />requirement for the conveyance of open space. They are presently <br />trying to rake it work with the condo statute, how to describe the <br />open space. <br />When they present the modification of the special permit this will <br />be part of it. <br />He has prepared a draft mr.of if ication. The client is now reviewing <br />it and then he will submit it to Tom to review and then will bring <br />it to the Board. <br />Tony stated that the Board would like to see the draft at the same <br />time ( as Tom) and preferably before the night of the meeting. <br />Mr. Butler stated that the modi.f icaiton is dealing with 4 issues <br />revised conditions, phasing, security, timing. <br />They will return on November 7th at 6:45. <br />PRELINIMARY PLAN <br />Applicant: Louis and Ethellen Ant.unes <br />Location: North side of Quinaquisett Avenue and west side of <br />Orchard Road, 12.3 acres. <br />Request: submission of Prelininary Plan. <br />Mr. Rich rerrera was present representing the applicant. <br />He stated that his client wants to f ile the cluster plan ( instead <br />of the grid) and a Special Permit application. <br />The Board had previously reviewed both plans. <br />Tom explained that as part of the, filing for a special permit they <br />will have to do a water quality report. There is no preiininary <br />plan required for a cluster plan. <br />Tony explained that it is the Board's opinion that the cluster is <br />not superior to the grid, he will have to convince the Beard that <br />it is. <br />There are the same number of lots in the grid as in the cluster. <br />Mr. Ferrera withdrew the preliminary plan. <br />He will submit a special permit plan with a water quality report <br />(10 copies). <br />Tom will give him the recent amendment to the water quality <br />requirement. <br />DISCUSSION <br />Discussion of Southport security for buffer area. <br />Louise and Judy stepped down. <br />On August 7 th , 1990 the Board extended for 90 days the r evege t ai on <br />requlrel,men t . <br />Tony stated that he believes the Board is in a postion to :�aqu].re <br />the security. <br />If the project is forclosed, these agr4er.eint s may not ba that <br />binding and the Board has no security. <br />3 <br />1 <br />
