Tom reminded the Board that they are not the special permit granting authority on this. He also stated that this is based on Phase II approvals. Tony stated that on February 7th the aggreement was they had *05 months to re -vegetate or provide a $250,000 Letter of credit. The Board will send a letter reminding Mr. B onvi e of his obligation to re --vegetate by November 7th, 1990 or, if he fails to perform f Phase Il approval becomes invalid. Tony will send him a return receipt letter and a copy to Mr. Dunning (Mr. Bonvie' s attorney) . The Board decided not to notify his bank at this point. Wayne made a motion to send the letter to Mr. Bonvie and his attorny reminding them there is little time left to re -vegetate or post a Letter of Credit or lose the Board approval of Phase Il. Pat seconded the motion. All other Board members were in favor (3-- 0). Christina Dierker of the Cape Cod Commission will meet with the Mashpee Planning Board, which -has been designated as the Local. Planning committee for Mashpee. Ms. Dierker was not present this evening. BOARD ITEMS Judy explained that she met with Ernie virgillion on. sarakummit . Ernie feels the money is enough to repair the road as per Charlie r s report. The Town is bound to this agreement, if there is any money left over they must return it to the applicant. Tony feels they should speak with Town Counsel on this issue before acting on the Letter of Credit. He does not feel the Board is in a strong position to invoke the Letter of Credit. Judy stated that Ernie is concerned they act. expediently so Zhe work can be completed this year, before the winter. Judy will meet with Town Councel next week. Pat asked if the Board can ask Charlie his opinion on the co -Sot of raising the road, for information purposes. Judy stated that Ernie f elt confident that there was enough money to raise the road. The Board. agreed to ask Charlie his opinion if it could be done quickly, without much cost to the Town. - 4 -
