Tom reminded the Board that they are not the special permit <br />granting authority on this. <br />He also stated that this is based on Phase II approvals. <br />Tony stated that on February 7th the aggreement was they had *05 <br />months to re -vegetate or provide a $250,000 Letter of credit. <br />The Board will send a letter reminding Mr. B onvi e of his obligation <br />to re --vegetate by November 7th, 1990 or, if he fails to perform f <br />Phase Il approval becomes invalid. <br />Tony will send him a return receipt letter and a copy to Mr. <br />Dunning (Mr. Bonvie' s attorney) . <br />The Board decided not to notify his bank at this point. <br />Wayne made a motion to send the letter to Mr. Bonvie and his <br />attorny reminding them there is little time left to re -vegetate or <br />post a Letter of Credit or lose the Board approval of Phase Il. <br />Pat seconded the motion. All other Board members were in favor (3-- <br />0). <br />Christina Dierker of the Cape Cod Commission will meet with the <br />Mashpee Planning Board, which -has been designated as the Local. <br />Planning committee for Mashpee. <br />Ms. Dierker was not present this evening. <br />BOARD ITEMS <br />Judy explained that she met with Ernie virgillion on. sarakummit . <br />Ernie feels the money is enough to repair the road as per Charlie r s <br />report. <br />The Town is bound to this agreement, if there is any money left <br />over they must return it to the applicant. <br />Tony feels they should speak with Town Counsel on this issue before <br />acting on the Letter of Credit. <br />He does not feel the Board is in a strong position to invoke the <br />Letter of Credit. <br />Judy stated that Ernie is concerned they act. expediently so Zhe <br />work can be completed this year, before the winter. <br />Judy will meet with Town Councel next week. <br />Pat asked if the Board can ask Charlie his opinion on the co -Sot of <br />raising the road, for information purposes. <br />Judy stated that Ernie f elt confident that there was enough money <br />to raise the road. <br />The Board. agreed to ask Charlie his opinion if it could be done <br />quickly, without much cost to the Town. <br />- 4 - <br />
