Aann rc ....Board <br />16 Great Neck Road North <br />Jklashpee, Nassachusetts 02649 <br />Ms. Waygan asked if public landings covers access to the great ponds or part of public access to water. <br />Mr. Lehrer said he would need to follow up with DNR but he believes it covers both. <br />Ms. Waygan stated it would be great if it did then it would get done. She would love if they could take <br />care of that entire bullet point. <br />Mr. Lehrer continued with the next action being to adequately budget for maintenance at existing public <br />access sites. The DPW has been working on enhancing numerous access points generally with joint <br />funds from the CPC and Capital Improvement Program. Other access points such as the boat ramp at <br />Mashpee/Wakeby are under state control. Investigate new sites for public landing, specifically 10 acres <br />at the end of Wills Work Road, Bufflehead Bay Land, Mitchells Landing, and Jack Pond Terrace. Public <br />rights of access to water is contested by adjacent property owners on Jack Pond Terrace. Boulders <br />block the entrance to Mitchells Landing for years. Jack Pond Terrace was not taken by the town when <br />Jack Pond was laid out for taking by Town Meeting. Terraces on Shoestring Bay have been topic of <br />debate in recent years. DNR used to launch a boat at Jack Pond Terrace which was contested by <br />neighbors questioning the public or private nature of the area. These should be investigated. <br />Bufflehead Bay is held under a Conservation Restriction and he is unclear if there is permissible access <br />due to restriction. <br />Ms. Waygan wonders if the Community Preservation could fund this work for a feasibility study. <br />Mr. Lehrer noted all former layouts prior to the subdivision all terminate at the water. They had a right of <br />access there similar to New Seabury all rights terminated at the water. When land was registered there <br />were cases where the judge in question did not make a finding relative to public rights of access and <br />since has never been rectified. We should seek to do that. <br />Ms. Waygan would like to write that as possible sub action step. There are professionals who could <br />help us determine that but who will fund it. <br />Mr. Lehrer commented that DNR is currently in the process of looking into access at Punkhorn Point <br />Road across from Gooseberry Island as well as on Daniels Island Road. There was a goal to adopt a <br />coastal picnic area with a sea view and that action has not been prioritized. The DNR did note a new <br />boat ramp is being contemplated for 2023 and he look into where that will be located. There is a kayak <br />launch at the north end of Bayview Road. He does need to follow up regarding the remaining sites from <br />the 1998 action plan. These identified ways to access water and historical public access sites were <br />compromised without no notation or decision by a judge delineating what rights were had to traverse <br />the ways to access water. Private land owners had success with preventing access but they can work <br />to rectify or confirm this. Next subject is waterways. Develop a multiple use water management plan <br />which is already underway via the Harbor Management Plan. There is a goal of enforcing boating <br />regulations and increasing harbormaster funding. With a full time year round harbormaster and <br />additional seasonal help all waterways except Santuit Pond and Ashumet Pond are actively patrolled by <br />
