16 Great Neck Road North <br />.Mashpee, .Massachusetts 02649 <br />Ms. Waygan would like Mr. Pesce's comments about meeting the design and road <br />construction standards that govern the subdivision of land. Regarding the Cape Cod <br />Commission, she would like a certificate of compliance. She is struggling with the fact it is not <br />special permit, and it's her understanding that an approval of a definitive subdivision plan <br />cannot be conditioned. It either complies or it doesn't, you cannot have provisional conditions. <br />She would like to see that land deeded conservation as well as confirmation of when and how <br />the lot was created. Before we talk about the traffic study she would like input from the public. <br />Mr. Kirrane will talk to the Cape Cod Commission and maybe they will be able to give him a <br />conditional certificate. It may require two separate plans coming before the Board. He will work <br />it out with them. <br />PUBLIC COMMENT <br />Arden Russell- She is an abutter to this proposal. As the portion of the property with access to <br />Main Street is zoned C3, the proposed subdivision is subject to 174-40: Access Ways to <br />Nonresidential Districts. This states there shall be a required minimum separation of 200 feet <br />between the center line to Rt. 130 and any other access way, or to the sideline of any street <br />intersecting said roadways. The 532 Main Street subdivision proposal clearly does not meet <br />this requirement. There are two access ways significantly less than 200 feet from the road and <br />that is Sturgis Lane and Bakers Road, an ancient way. In the zoning, for safety reasons, less <br />than 200 feet of separation between major intersections is not safe. As she tries to leave <br />Sturgis Lane now, she needs to deal with a significant amount of traffic to the south from <br />Nicolettas Way, Maffei Landscaping alone creates hundreds of trips per day. Now, possibly, a <br />significant amount of traffic directly to her north, much less than 200 feet away, with this <br />proposed road, how is she going to get out? Both of these intersections are in very close <br />proximity to Sturgis Lane and Bakers Road. There is currently a significant amount of traffic <br />from Echo Road and now from Evergreen Circle, which is not even completely developed yet. <br />Cape Cod Coffee, the dispensary, and many other additional industrial businesses create <br />hundreds of cars. As this proposed subdivision does not comply with zoning 174-40, and for <br />the safety of the community, she urges the Planning Board to not grant approval of this <br />subdivision road. <br />Ms. Waygan asked in that traffic study scope, if it has suggestions on how to proceed in <br />making things safer? <br />Mr. Lehrer stated the study is to assess the impact of the actual proposal. It is in consideration <br />of the predominant use of the district and future build out projections, at certain peak hour trips, <br />generally from 7:OOa.m.-9:OOa.m. in the morning and 6:00p.m.-8:00p.m. in the evening for the <br />96 hour constant traffic count.
