Ridenour <br />79 Neshobe Road <br />(Map 125 Parcel 56) <br />Mashpee, MA 02649 <br />Doc.: 1463279 <br />Ctf.: 230507 <br />A Petition was filed on August 30, 2022 by Owner, Kimberly A. Ridenour requesting a Variance <br />under § 174-31 (Land Space Requirements) of the Zoning Bylaws to allow for construction of a 24 <br />ft. by 28 ft. detached garage on property located in an R-3 Zoning District, Map 125, Parcel 56, <br />Mashpee, MA. <br />Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br />Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br />the Town of Mashpee, on September 16, 2022 and September 23, 2022 a copy of which is attached <br />hereto and made a part hereof. <br />The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br />Massachusetts General Laws Chapter 40A § 10 and the Town of Mashpee Zoning By-laws. <br />Public Hearings were held on the Petition at the Mashpee Public Library on Wednesday, October <br />12, 2022 at which time the following members of the Board of Appeals were present and acting <br />throughout; Acting Chairman, William Blaisdell, Board Members, Ron Bonvie, Scott Goldstein, <br />Norman J. Gould, and Associate Member, George Ganzenmuller. <br />Mr. Ridenour represented the Variance request for a 24 ft. x 26 ft. detached garage with a bedroom <br />above. The dimensions of the garage were revised at the hearing, but not shown on the plan. The <br />site plan depicts a proposed three (3) bedroom house, with an attached garage that was recently <br />issued a building permit. The Variance request is from the front setback for the detached 24 ft. x <br />26 ft. garage. <br />The Health Agent submitted comments and were read into the record as noted; "Plan shows an <br />apartment on second level with bedroom and plumbing. There is no septic plan to service this area. <br />Septic design to service main house is not large enough to handle the 5th bedroom and a single <br />compartment tank is not allowed to service two buildings. Unless new septic plans are submitted <br />the Health Department cannot approve the livable space above the detached garage." <br />Mr. Ridenour met with the Health Agent and discussed adding another tank on the property, and <br />submitting a new floor plan depicting a 6 ft. opening for one of the other rooms in the main house. <br />
