MASHPEE ZONING BOARD OF APPEALS <br />DECISION FOR A SPECIAL PERMIT <br />Owner, Jordan Keliinui <br />83 Red Brook Road (Map 104 Parcel 4) <br />Mashpee, MA 02649 <br />SP-2022-45 <br />SPECIAL PERMIT CONDITIONS <br />In view of the foregoing, the Board determined the Petitioner met the criteria for a Special Permit. <br />Upon motion duly made and seconded at the Public Hearings on Wednesday, October 12, 2022, the <br />Zoning Board of Appeals voted unanimously to issue a Special Permit to Owner, Jordan Keliinui of <br />83 Red Brook Road under § 174-17.1 of the Zoning Bylaws to raze a non -conforming single family <br />residential structure and replace it with a new two bedroom structure; and a detached accessory <br />dwelling unit (ADU) on property located in an R-3 Zoning District, Map 104 Parcel 4, Mashpee, <br />MA with the following conditions; <br />1. The Board has determined that the applicant meets all the conditions of a Special Permit <br />under Mass General Law 40A Section 9. <br />2. Site Plan — Prepared for Jordan Keliinui, 83 Red Brook Rd., Mashpee, MA, Scale: 1" = <br />20', Date: July 7, 2022, Prepared by Warwick & Associates Inc., Signed and stamped by: <br />Gary S. Labrie, No.: 40039 Registered Professional Land Surveyor. <br />3. House Plans — Keliinui Residence, 83 Red Brook Road, Mashpee, MA, Scale: 1/4" = 1', <br />Date: 9/18/2022, Drawing No.: Al: Main House Floor Plan, ADU Floor Plan, A2: Left, <br />Front, Rear, and Right Elevations, A3: Left, Front, Rear, and Right Elevations, Prepared <br />by Cotuit Bay Design LLC. <br />4. Conditioned on all Town Department comments read into the record. <br />5. An asbestos and rodent inspection performed unless waived by the Board of Health. <br />6. Noted that the Fire Chief stated that there are four conditions that have to be met in his <br />letter/email dated Wednesday, October 12, 2022, 7:56 am listed here; <br />1. The ten (10') foot easement be cleared and maintained to the sixteen (16') foot <br />height. <br />2. The driveway surface be improved to an all-weather surface driveway capable of <br />supporting fire apparatus in all weather conditions. <br />3. The power line moved to allow for the sixteen (16') foot clearance. <br />4. Two propane tanks on the property, beside the home, need to be properly disposed <br />of. <br />7. A letter entered into the record from Attorney Mills addressing the four items from the Fire <br />Chief. <br />3 <br />
