Earle Marsters responded <br /> they Itnow exactly gnat the zoning is there r1gat now, what pape-- subdivisions are there <br /> now and the owner nas said he won.•t go torward, <br /> Charles Buckingham -asked if an overlay map had been made to show what exists and what <br /> was grandfathered in and you flip it to see what's current zoning and what estab.li-sh-ed. <br /> He said money had been voted for that. Brian Barber said money was initially voted <br /> to do a land use survey but a decis ion,was made not to do it and proposed to go with <br /> last -year'-s zoning changes and .didn't prepare a large town-wide map but prepared <br /> center -area -with existing development constraints of current -zoning, existing build- <br /> ings- and paved areas. He went on to explain Rw4 density is 4 units/acre and the <br /> existing area is R-3 which is 40,000 sq a ft. R-5 zoning is established around the <br /> Quashnet and Mashpee Rivers and increases from. 40,000 to 60,000 sq.ft. and the pro- <br /> t active corri-dor on the Mashp-ee River increases to 300' -to offset the increase in <br /> th,e R-4 area so you don't have a big change, <br /> There were comments brought up in the audience regarding the 3UU' -setback on the <br /> Mashpee and Quashnet Rivers e Mang felt it would be a taxing of land. They felt -the <br /> To=an would open itself up to lawsuits and they pointed out several lots that would <br /> be rendered unbuildable because of it, George Benway stated he knew of three such <br /> lots and Mr, Mills had just purchased 5 acres of land and he wouldn't be able to <br /> build a house if the 3001 is initiated. Mr. Arnold Chase stated he recently -submitted <br /> a preliminary plan abuutti.ng-th0_ Mashp-ee Pliver and'he felt according to state law, <br /> going the 300' would render a taking and the town would have to reimburse him for <br /> his land. A representative of the Trustees of Reservation said they have hundreds <br /> of acres on the rivers and felt going 300' would be beneficial. Many people felt <br /> litigations could be brought against the totm and they felt the Board shouldn't be <br /> inviting this, <br /> Richard Terror said he didn't feel that one single lot would be rendered unbuildable <br /> due to the 300' setbacks He said if there are they could go to the Board of Appeals <br /> for a variance and he would go with -the=n before the Board of Appeals and recommend it. <br />
