First : Can the open space be moved, he had heard <br /> a of the Town taking the Golf Course ;- could. it. -be moved. Mr <br /> proposal <br /> Marsters informed Mr. De lory that a covenant exists and- he doesn' t think <br /> so • Planning Board has requested a copy of the covenant .and this will <br /> clearlydefine same when received. Mr. Delory'-s question No-. 2 - Can <br /> the Town purchase something that can' t be touched or built upon. Mr. <br /> Marsters informed him that whomever takes over, whether it be a bank <br /> or whatever, they cannot build on that land as- it is dedicated forever <br /> as Open Space, Mr. Blakeman. -stated it could cease being a golf course <br /> and become a field, but it still couldn'--t be built upon. Mr. Blakeman <br /> the_ n questioned as a golf course and owned as a commercial venture , does <br /> it still constitute open Space, Mr, Marsters stated in the affirmative ,. <br /> Mr. Blakeman is under the impression that the abut t ors had to have an <br /> absolute actual access to open Space and in -the case of New ' Seabury or <br /> Umin'..as , i,f -you d.on"t pay the admission fee, one does not have access . <br /> Mr. Delory then asked if it could be sold separately whereas the owners <br /> do have vested interest in the open space even though they probably <br /> don` t la golf, Mr.. Holmes then stated it can be deeded to the Tow-* <br /> play <br /> Mr. Blakeman asked. if - this fee for the course didn't violate the cluster <br /> zon.in g concept..
