MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 9, 2023 <br /> Chairman Bonvie said that the Board in the past has recommended to the applicant to have a <br /> conversation with their neighbors. The Board does not have the right to condition that the applicant <br /> meet with a neighborhood association. <br /> Mr. Orsi said that the Building Inspector was very helpful, and the contractor and applicant met <br /> with the Association. <br /> Chairman Bonvie asked Attorney Kirrane if his client could meet with the Mr. Orsi and the <br /> Association. Attorney Kirrane did receive a copy of the letter and he forwarded it to the <br /> development team. The general contractor is very aware that there are concerns and is willing to <br /> have a conversation with the neighbors. <br /> Attorney Kirrane asked that the Board not impose a condition if the plans have changed to return <br /> to the Board. His understanding is that the driveway will be eliminated and he would not have to <br /> return to the Board if the driveway is taken out, if that is the only change. There is a driveway on <br /> Overlook Knoll Road that will provide sufficient parking. <br /> Chairman Bonvie stated that a condition can be made that the driveway will be removed from the <br /> Seaview side. <br /> Mr. Frank Walls, 3 5 Shore Drive asked what will be in place of the driveway. <br /> Attorney Kirrane said it will be natural vegetation. No structures. <br /> Mr. John Hauss, 15 Seaview Avenue. He asked how the height of the building is measured. He <br /> asked if the house could be shifted back toward Overlook Knoll Rd. He questioned the 13 ft. <br /> setback. <br /> Mr. Morris said the measurements are of the average natural grade which is in the zoning bylaws. <br /> Attorney Kirrane said that the 13 ft. setback is measured from the deck. <br /> Chairman Bonvie explained to Mr. Hauss that the structure will become conforming. <br /> Mr. Masiello mentioned that the wall is 30 inches high. <br /> Mr. Sean Braney, Contractor said that he can remove the wall. <br /> Chairman Bonvie said that any changes to the plan will require the applicant to return to this Board. <br /> Attorney Kirrane agreed to comply with the Board's request to remove the wall from the plans. <br /> There were no more comments from the Board or audience. <br /> 9 <br />
