MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 9, 2023 <br /> Attorney Kirrane stated that the beneficiary is the wife of the Trust.He provided all the deeds from <br /> the common owner and there's much more than what is relevant. <br /> Mr. Reidy does not believe the burden of proof has been fulfilled. <br /> Attorney Kirrane believes he provided the Board enough to prove his case. <br /> There were no comments submitted from abutters. There were no comments from the Board or <br /> audience. <br /> Ms. Sangeleer made a motion to close the public comments. Mr. Furbush seconded. All were in <br /> favor. <br /> Mr. Reidy made a motion relative to 363 Monomoscoy Road, Petitioner, DEER Realty Trust, <br /> Janice Copp Burns, Trustee requests an Appeal of the Building Commissioner's Decision under <br /> M.G.L. Chapter 40A§§8 and 15. Petitioner disputes the Building Commissioner's determination <br /> that the lot has merged with 7 Cricket Way, and is entitled to a building permit on the basis that <br /> the lot is grandfathered under the Zoning Bylaw §174-21 (A), and M.G.L. c. 40A §6. <br /> Mr. Reidy motioned that the Board vote to deny the request and uphold the Building <br /> Commissioner's Decision. Mr. Furbush seconded, yes, Ms. Sangeleer, yes, Mr. Reidy, yes, and <br /> Mr. Bonvie, yes. All were in favor to support the Building Commissioner's Decision. <br /> NEW HEARINGS <br /> Sitting on this hearing are the three regular Board member, Mr. Ganzenmuller and Mr. Pittsley. <br /> 165 Whippoorwill Circle: Owners, Lloyd J. and Ronnie Stowell, Trustees request a Written <br /> Finding under§174-17 and §174-33 of the Zoning Bylaws to allow for an attached garage addition, <br /> extension to a pre-existing, non-conforming single family dwelling on property located in an R-3 <br /> Zoning District, Map 125 Parcel 172, Mashpee, MA. <br /> Mr. Robert Gremo, Building and Design and John Saleco represented the application for a Written <br /> Finding. Mr. Gremo mentioned that he had a discussion with the Building Commissioner and was <br /> required to apply with the ZBA. <br /> Mr. Morris stated that the project requires zoning because of the setbacks to wetlands. <br /> Mr.Furbush noticed that there was an existing shed located on half of the neighbor's property.Mr. <br /> Saleco mentioned that he can remove that. <br /> Chairman Bonvie said this could be a condition to remove the shed, or moved off the subject <br /> property. <br /> 3 <br />
