MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 9, 2023 <br /> Attorney Kirrane stated that the proposed dwelling will be situated on the same foot print as it <br /> exists now. There are no new non-conformities being created,and is not intensifying any new non- <br /> conformities. The proposed structure coverage is under 25%at 19.8%. There are no changes to the <br /> existing setbacks or lot coverage. <br /> The septic system will be an IA system that was approved by the Board of Health, and was <br /> approved by the Conservation Commission. The structure will be built on pilings and will be flood <br /> zone compliant, building code compliant, and energy code compliant. Drywells will be installed <br /> to capture all water runoff. The new structure will be built similar to other structures in the <br /> neighborhood, and is not more detrimental to the neighborhood than what currently exists. <br /> Mr. Reidy read the Board of Health Agent comments dated July 28, 2023 into the record; "No <br /> increase in bedrooms, to remain 3 bedroom. Title 5 completed 5-20-23. ", and the Conservation <br /> Agent comments dated July 31, 2013; "This project was approved by the commission and issued <br /> an order of conditions at their July 27` public meeting. ", and the Assistant Conservation Agent <br /> comments dated August 2, 2023; "NOI application for a raze and replace of existing home and <br /> installation of IA septic was approved by the Commission. " <br /> Attorney Kirrane mentioned that the site plan does show the lot and structure coverage. <br /> Mr. Morris had no comments. There were no more comments from the audience or the Board. <br /> Ms. Sangeleer made a motion to close the public comment. Mr. Furbush seconded. All were in <br /> favor to close the public comments. <br /> Mr. Reidy made a motion relative to 25 Menemsha Road, Owners, Paul J. and Kathryn M. <br /> Thurston request a Special Permit under §174-17.1 and §174-33 of the Zoning Bylaws to allow <br /> for a raze and replace of a pre-existing,non-conforming single family dwelling on property located <br /> in an R-3 and Popponesset Overlay District(s), Map 123 Parcel 140, Mashpee, MA with the <br /> following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> under Mass General Law 40A Section 9. <br /> 2. Site Plan— Prepared for Paul J. & Kathryn M. Thurston, 25 Menemsha Road, Mashpee, <br /> MA. Scale: 1" = 10', Date: June 12, 2023, Prepared by: Flaherty& Stefani, Inc. <br /> 6 <br />
