2 <br />Mashpee Select Board <br />Minutes <br />August 28, 2023 <br />OLD BUSINESS <br />Discussion and Possible Approval of November 7,.2023 Staecial Election Hours: Town Clerk Deborah <br />Kaye: (continued) _.,.. <br />Motion made by Selectman Wyman -Colombo to maintain the regular voting hours; 7:00 a.m. to <br />8:00 p.m. for the Special Election of November 7, 2023. <br />Motion seconded by Selectman O'Hara. <br />VOTE: Unanimous. 4-0. <br />Roll Call Vote: <br />Selectman O'Hara, yes Selectman Sherman, yes Selectman Weeden, yes <br />Selectman Wyman -Colombo, yes Opposed, none <br />Discussion with Regard tq Articles Submitted bar the Planning Board for the October 16„ 2023 Town <br />Board Chair Karen Faulkner: <br />Meets_ 'n�� Warrant Town Planner Evan Lehrer;w ,planning _ <br />The Select Board reviewed the Town Meeting warrant articles previously placed on hold with the Town <br />Planner Evan Lehrer and Planning Board Chair Karen Faulkner. <br />Article #6: Tree Preservation Bylaw <br />This article is intended to incentivize the protection of certain trees on residential, commercial and <br />industrial lots in the Town of Mashpee. It would require prior to any building activities, the submission <br />of an application and plan to the Planning Department that identifies trees that qualify as "Protected <br />Trees" as defined in the article. This eliminates the ability for property owners to "clear-cut" their lot <br />prior to a building activity, and to encourage the preservation of existing trees for their environmental <br />benefits and positive impact on the character of the community. <br />With input from the Director of Public Works, the Town Planner reviewed the slight modifications to <br />the article that have no impact to the scope of the article, but provide additional clarity. <br />It was noted the Planning Board unanimously voted to affirm the language of the article to present to the <br />Select Board for approval. <br />The proposed Tree Preservation Bylaw is focused on building activity. It provides a balance between <br />property rights, building and preservation. <br />A list of tree species that are protected trees is provided in the bylaw. Removal of protected trees shall <br />require a permit before being removed, encroached upon, or in some cases, pruned. Invasive or likely <br />invasive species as defined in the Bylaw are not protected trees. <br />For ease of review and understanding definitions of key terms and an outline of how the Tree <br />Preservation Bylaw would apply to an owner of a lot or parcel of land as well as a schematic of a tree <br />yard was reviewed. <br />
