Mashpee Select Board <br />Minutes <br />August 28, 2023 <br />Discussion with Regard to Articles Submitted by the Plannm Board for the October 16, 2023 Town <br />Meeting Warrant: Town Planner Evan Lehrer Plannin Board Chair Karen Faulkner: <br />It was noted the Planning Board has not reviewed the Zoning Bylaw amendments. The Town Planner <br />gave input to the following; <br />Article #2: Amend Zoning Bylaw Floodplain Zone Overlay <br />The Town Planner agreed the final sentence of the first paragraph could be potentially problematic, and <br />recommended striking the last sentence. <br />Article #3: Amend Zoning Bylaw to allow property owners who construct accessory apartments to <br />live in their accessory apartment and rent their principal dwelling to tenants. No change recommended. <br />Article #4: To clarify the allowed size of an accessory apartment to within a defined range. <br />After discussion it was recommended to maintain a minimum unit size of 350' square feet and a <br />maximum of 900' square feet, and to eliminate the 40% ratio to the fixed minimum, maximum. <br />Article #5: To require any accessory apartment that is created be rented year-round for a period no <br />less than 12 months; adding language providing there be a signed lease to be retained on <br />file with the Building Department for monitoring and compliance. <br />fj 2023 Town <br />Discussion, wA � °�roval and Recommendations of Articles on Draft #4 of the October 16 .._ ........ <br />Meetin Warrant: <br />Article #2: Amend Zoning Bylaw Floodplain Zone Overlay <br />Motion made by Selectman Weeden to include and recommend Article #2 with the last sentence <br />deleted under Prohibitions. <br />Motion seconded by Selectman Wyman -Colombo. <br />VOTE: Unanimous. 4-0. <br />Roll Call Vote: <br />Selectman O'Hara, yes Selectman Sherman, yes Selectman Weeden, yes <br />Selectman Wyman -Colombo, yes Opposed, none <br />Article #4: To clarify the allowed size of an accessory apartment to within a defined range. <br />Motion made by Selectman Wyman -Colombo to include and recommend Article #4 eliminating <br />the 40% calculation, requiring a minimum unit size of 350' sf. and a maximum unit size of 900' sf. <br />Motion seconded by Selectman O'Hara. <br />VOTE: Unanimous. 4-0. <br />Roll Call Vote: <br />Selectman O'Hara, yes Selectman Sherman, yes Selectman Weeden, yes <br />Selectman Wyman -Colombo, yes Opposed, none <br />
