MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> APRIL 28, 2021 <br /> Attorney Kevin Kirrane, represents JD Mercantile Properties who is the current owner. <br /> Back in 2017, the Board approved a Special Permit for construction of a 7,440 sq. ft. <br /> industrial building. It was issued to Cape Wide Construction, Inc. who was the applicant <br /> at that particular time. The current request is to add a smaller building consisting of 4,920 <br /> sq. ft. on the rear of the site behind the existing building, and is consistent with the <br /> contractor bay use in the existing building. There will be four contractor bays in the four <br /> units. The additional square footage requires some six additional parking spaces, bringing <br /> the total number to 15 spaces. The application under the bylaws include contractor bay <br /> office space. The Board must consider the findings under §174-23C (2) for considering of <br /> health and safety. The additional building will be an expansion of additional uses. There <br /> are no wetlands on this approximate site. <br /> Attorney Kirrane mentioned that Dan O'Jala did the engineering for the site, and Joao <br /> Junqueira is the contractor and owner of the site who will be constructing this building, <br /> and the appropriate precautions have been taken to ensure that any surface water is <br /> addressed and retained on the site. The septic system can be addressed by Dan that were <br /> submitted to the Board. The building will conform to all setbacks and parking. The use is <br /> permitted by a grant of a Special Permit by the Board. <br /> Mr. Furbush wanted to know the total amount of contractor bays, and if this would require <br /> more handicapped spaces. He also asked what type of businesses will be occupying the <br /> contractor bays. Dan O'Jala said that only one space is required because there's no curbing <br /> and is very level. If the building were open to the public, or had retail space than an extra <br /> space would be needed. <br /> Joao said that the bays will be used for storage, or landscapers, or other contractors. He <br /> said that one of the bays will provide storage for a wood working contractor, and the others <br /> are for dry storage of furniture. <br /> Attorney Kirrane said that at one time the Town required a Special Permit for every <br /> business that went into any space in Mashpee,but that has changed over the years, as long <br /> as the business is consistent with the original uses that were authorized under the <br /> construction of the building. If the Board wanted to impose conditions relative to the <br /> storage of chemicals, the Board has the right to do that. <br /> The Board has a copy of the lighting plan. Dan said that there is not much lighting required. <br /> There will be some LED wall packs downward facing between the two buildings. If a <br /> vehicle is stored, a condition can be imposed that a floor drain be installed. The tank will <br /> be fully contained. <br /> Attorney Kirrane said that a permit from the Fire Department would be required for any <br /> storage of chemicals. <br /> Joao said that there are no plans for office use,just warehouses. <br /> 10 <br />
