The Town Planner explained that some time ago the Planning Board signed an <br /> Approval Not Required plan for property at Monomoscoy. One of the parcels was to <br /> have been deeded over to someone else, however this was never executed and now <br /> Attorney Simmons is requesting that the Planning Board rescind the ANR plan. <br /> The Town Planner is of the opinion that the property is not a buildable lot, all of <br /> the frontage requirements were met and that the Town is not responsible to enforce an <br /> agreement between two private parties regarding a transfer of property. As Mr. Rowley <br /> has pointed out,there is no process to rescind an ANR plan. <br /> The Board authorized the Town Planner to respond to this correspondence stating <br /> the Board's position to uphold their decision and acknowledge they have no jurisdiction <br /> to enforce a land transfer. <br /> Public Hearing <br /> Scott Bauer- 8 Blue Castle Drive <br /> Approval of 2-Lot Definitive Subdivision Plan <br /> The appointed hour having arrived the Chairman read the Public Hearing notice <br /> into the record and called the Public Hearing to order. <br /> The Chairman then informed the Board that Applicant has requested to withdraw <br /> the application due to title issues. <br /> "I would like to thank you all for the time you spent on my subdivision plan. <br /> Throughout the whole process I always felt that good progress was being made and that <br /> you treated me with decency and respect and that you were reasonable and I hope that the <br /> feeling was mutual. At this time I regret that I have to withdraw my plan due to a title <br /> issue beyond my control. I look forward to working with you in the future. Thank you. <br /> Scott Bauer." <br /> The Chairman then entertained a motion to close the Public Hearing,with a <br /> further motion to accept the Applicant's request to withdraw. <br /> MOTION: Dennis Balzarini made a Motion to close the Public Hearing in this <br /> matter; which Motion was duly seconded by Thomas O'Hara and so voted unanimously. <br /> MOTION: Dennis Balzarini made a Motion to accept Applicant request to <br /> withdraw the application in this matter; which Motion was duly seconded by Thomas <br /> O'Hara and so voted unanimously. <br /> AMENDED MOTION: Dennis Balzarini made an Amended Motion to <br /> procedurally deny the application without prejudice in this matter; which Amended <br /> Motion was duly seconded by Thomas O'Hara and so voted unanimously. <br /> 7 <br />
