He will send it to petitioner for comment as <br />well. <br />Mr. Hansen asked what happens when we get a new bylaw, we are all in agreement, now ZBA <br />does what with the bylaw? He's looked at some ZBA approvals. They seem blatantly outside <br />the bylaw guidelines. <br />Mr. Lehrer answered if we adopted a bylaw there will be far more clarity around how they <br />render decisions. If they are ignored then the town would be subject. An applicant can request <br />to alter and we would prescribe certain actions that would determine detriment. <br />OLD BUSINESS <br />Review update draft implementation table of the Local Comprehensive Plan Update <br />Ms. Waygan noted the time is late and she would like to hold off on this until December 20t" to <br />see if more of it can be digested. <br />Mr. Balzarini did transportation, Mr. Lehrer stated the section is in very good shape regarding <br />goals, policies, and actions. One modified action contemplates utilization of mitigation dollars <br />taken in by DRI, and since that application has been withdrawn. Action TC3, there are a <br />number of intersection improvements by Shellback Way, all of them carried through in the <br />table and proposed as an action. The project was referred to the Commission at subject site to <br />implement intersection improvements. That project is withdrawn and unclear if it will resubmit, <br />if a Special Permit is sought it should be a condition requiring improvement of that intersection <br />or a DRI. <br />Mr. Lehrer commented the town has been accepting layouts without consideration to <br />maintenance costs and we have an action that considers the Select Board modify the road <br />taking policy. It costs the town just to perform the study. If we decided not to do the road the <br />town is out $80,000. Lastly, he wants to include as an action, 209 Old Barnstable Road traffic <br />study. He can run a report outlining a series of actions or improvements. <br />Mr. Balzarini noted under TC9 to have transportation, we also need bus shelters. Ms. Waygan <br />stated they cost about $35,000. TC10 says to establish a transit hub to go to Boston in or <br />around the Mashpee rotary. TC11 notes to work with Mass DOT with the retrofit. Mr. Balzarini <br />does not want to change the rotary. Mr. Lehrer noted there is potential for a modern <br />roundabout in efforts to reduce traffic and increase flow, it is worth reevaluating long term <br />potential and evaluate in the future. Retrofit is enough. <br />Mr. Lehrer stated the Town vehicles have not used gas in three years. Mr. Balzarini inquired <br />about an electrical dump truck. He would like to note the carbon emissions with the battery <br />destruction. <br />10 <br />
