The lot area of the lot shown is conforming in <br />accordance with the zoning bylaw. It does not clearly indicate 150ft. of frontage. <br />Mr. Balzarini stated the lot has 141ft. He asked if the easement proposed on the plan was the <br />driveway access. He added that counts to give that lot 150ft. Mr. Pesce checked and each lot <br />is conforming. He added there is nomenclature from point to point, also called the arc length. <br />Mr. Lehrer suggested the plan be submitted and endorsed as an ANR. The Planning Board is <br />certifying there is adequate frontage, land area, and access. Any area of a lot that is wetland <br />cannot contribute to overall lot area. <br />MOTION: <br />Ms. Waygan made a motion to endorse the ANR. Seconded by Mr. Balzarini. All in favor. <br />Applicant: Estate of Jacques Fresco <br />Location: 3 Santuit Lane, Mashpee, MA <br />Assessor's Map 30 Parcel 15 <br />Request: The purpose of the request is to rectify an existing encroachment of the <br />subject property on Town of Mashpee Conservation lands. The plan <br />proposes to divide the subject lot into two parcels 1 and 2. 0 Santuit Lane <br />(Map 30, Parcel 19) is Town of Mashpee Conservation land proposed to <br />be divided into two parcels 3 and 4. Parcel 1 will be conveyed to the Town <br />of Mashpee and Parcel 3 will be conveyed to the Estate of Jacques <br />Fresco. Parcels 2 and 4 will be merged to create new building lot 26A as <br />shown on the plan. <br />Ms. Faulkner inquired about the attached documents. <br />Mr. Lehrer commented that plans, required fees, and application forms are all up to date. <br />There is a letter from Attorney Bryan Wall in the packet that outlines the nature of the request. <br />Attorney Bryan Wall is present on behalf of the property owner, he is here as an attempt to <br />correct a problem. The owners became advanced in age and realized their land encroaches on <br />town land, all have approved of this transfer and Town Meeting voted in favor. However, there <br />is special legislature in regards to conservation. The problem is being rectified between the <br />town and the clients. There is a land swap of 2,940s.f. from the town and the estate, from one <br />to the other. The town land will acquire the wetlands, it will be privately owned and transferred <br />into conservation. <br />Mr. Lehrer recommends endorsing. <br />PA <br />
