Attorney <br />Kirrane noted that would be fine. <br />MOTION: <br />Ms. Waygan made a motion to continue this Public Hearing to November 1, 2023 at <br />7:20P.M. Seconded by Mr. Richardson. All in favor. <br />7:25PM (Continued from 08/16/2023) <br />Applicant: Pleasantwood Homes, LLC <br />Location: 20 Tudor Terrace (Assessor's Map 29 Parcel 198) <br />Request: Applicant is seeking approval of a Definitive Subdivision <br />Christopher Kirrane is requesting a continuance to November 1, 2023 to extend the time frame <br />for the Board's 90 day decision. <br />MOTION <br />Ms. Waygan made a motion to continue this Public Hearing to 7:25P.M. on November 1, <br />2023 and extend the Board's 90 day decision. Seconded by Mr. Richardson. All in favor. <br />NEW BUSINESS <br />Attorney Don Pinto's letter transmitted to Mashpee Town Counsel <br />Ms. Faulkner noted the Planning Board raised some issues from 1991, the 853 bedrooms, <br />density, and wastewater capacity. This letter is insinuating litigation. We aren't getting into <br />anything tonight, but Counsel is suggesting an executive session. <br />Ms. Waygan noted this needs to be discussed during Public Hearing session. This matter of <br />the bedrooms, the applicant has applied for a special permit modification, she has read this <br />letter twice. She feels this pertains to one if not all applications that are in front of us that have <br />been continued. Any discussion about those needs to be public. That letter needs to be <br />officially submitted to the packet of materials and discussed, ex parte conversation. She is very <br />uncomfortable with going into an executive session and does not believe this qualifies. <br />Ms. Faulkner noted Town Counsel is advising this. <br />Ms. Waygan commented he is not a resident, he is not a member of this Board, and we need <br />to have a discussion through proper process, deliberation, and decision. Town Counsel has no <br />authority over us. She does not have a letter from him, she has hearsay. She feels very <br />strongly about this. <br />:l <br />
