Counsel felt this letter is <br />an imminent threat of litigation and would recommend executive session, but it is not required. <br />Ms. Waygan spoke to the Town Manager today. She will be following up with him tomorrow. <br />She will be very clear to him, when something like this happens it needs a cover letter, it needs <br />to be sent to the Planning Board in an official packet. This was dated July 31st. Where has this <br />letter been? <br />Mr. Richardson stated there is a request on the table and the Board needs to respond to this. <br />Ms. Waygan is requesting a formal letter from Town Counsel. She is not making a motion to <br />then cause problems with this Board. She is uncomfortable making this motion. <br />Mr. Lehrer will request a follow up from Town Counsel on behalf of this Board. <br />MOTION: <br />Mr. Richardson made a motion to allow the Town Planner to request a clarifying letter <br />from Town Counsel to the Planning Board. Seconded by Mr. Balzarini. All in favor. Ms. <br />Waygan abstains. <br />OLD BUSINESS <br />N/A <br />BOARD ENGINEER REPORT <br />Sherwin Williams <br />There were drainage issues in the detention pond, so areas were washed out. It was lacking <br />proper crushed stone and a contractor showed up yesterday to repair. Following pictures of <br />completion, this project can get closed out. Some areas never got seeded or didn't take well so <br />those areas were also repaired. Now we wait a couple weeks and watch for the seed to come <br />in. <br />Willow Circle <br />The infrastructure is in and binder pavement is down. There is a new stone wall at the <br />entrance but there is nothing to inspect. He was originally concerned about clearance on the <br />corner entrance, but the entrance road was moved over by narrowing the island. Once that <br />comes into fruition Mr. Pesce will inspect. <br />11 <br />
