MASHPEE ZONING BOARD OF APPEALS
DECISION FOR A MODIFICATION EXTENSION OF
SP-2015-33; SP-2019-36; SP-2020-28; MOD-2023-08
Owner of Record: Triple M Management Company, LLC
29 Echo Road (Map 19, Parcel 3-9) and,
Owner of Record: Triple M Management Company, LLC
41 Echo Road (Map 19, Parcel 3-8)
Mashpee, MA 02649
MOD-2023-69
Attorney Kirrane said his client consulted with the Fire Department, but he did not hear that they
had any concerns. Mr.Kirrane provided the Board with a progress report and an estimated timeline
of the projected work to be performed.
Chairman Bonvie had concerns that were presented by the Fire Department, and the Building
Commissioner.
The comments submitted by Catherine Laurent, DPW Director dated November 29, 2023 were
read into the record: Echo Road is a Town road. While the original project did receive a Cub Cut
Permit from the DPW, this permit has expired. Since then, an issue has arisen with the turning
radius for the driveway aprons. The radius is too short/abrupt so vehicles and large trucks entering
or exiting the property "cut the corner". This is causing a 'pothole" at each corner and will
eventually break down the edge ofpavement for Echo Road. I request that any approved extension
be conditioned upon the widening of the paved turning radius for each entrance and exit for the
properties within the next six months.
Attorney Kirrane stated that if the Board is willing to extend the time of completion until January
31,2024,he will agree to continue the hearing until January 24,2024.The procedure would require
a new application extension from January 31,2024 to May 31, 2024 because the Board is granting
a modification from"X" date, and another modification would be required.
Chairman Bonvie accepted a continuance contingent upon the Board receiving definitive
comments from the Fire Department, and Mr. Morris, Building Commissioner. Attorney Kirrane
asked for an extension of the completion date of Condition 5 of the existing Special Permit until
January 31, 2024.
On January 24, 2024, the continued hearing was opened, at which time the following members of
the Board of Appeals were present and acting throughout; Chairman, Ronald Bonvie, Sharon
Sangeleer, William A. Blaisdell, Jonathan Furbush, and Scott Goldstein. Also present was David
Morris, Building Commissioner, and Jack Phelan, Fire Chief.
Attorney Christopher Kirrane represented the applicant's request for a continuance of the
modification. The Board wanted to receive definitive comments from both Mr. Morris, Building
Commissioner and Mr. Phelan, Fire Chief.
2
