Flammini requesting <br /> a Special Permit under §174-17.1 of the Zoning Bylaws to allow for a raze and replace of a pre- <br /> existing, non-conforming single family dwelling on property located in an R-3 and Popponesset <br /> Overlay District(s),Map 118 Parcel 34, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on July 14, 2023 and July 21, 2023 a copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, August 9, <br /> 2023 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Ronald Bonvie, Chairman, Sharon Sangeleer, Vice Chair, Board Member, Jonathan <br /> Furbush, and Associate Members, George Ganzenmuller and Bradford Pittsley. <br /> Attorney Christopher Kirrane represented the homeowners for the Special Permit request to raze <br /> and replace a single family dwelling. Also present was Bill Masiello,Architect, and Sean Braney, <br /> General Contractor for this project. This site is located in the R-3 and within the Popponesset <br /> Overlay Districts. This property is not in a flood zone, and is not within Conservation jurisdiction. <br /> The lot itself meets the requirements in the Popponesset Overlay District. It has over 6,000 sq. ft. <br /> of lot size area, and has 75 ft. of frontage, and is a conforming lot. The unique contour of this lot <br /> is that it also fronts on Seaview Avenue. According to the Town bylaws, it needs to meet the <br /> frontage requirements on both Seaview Ave and Overlook Knoll Road.The only pre-existing non- <br /> conformity is the front yard setback to Seaview Avenue which is 13.1 ft.There will be an IA septic <br /> system installed, and there are no new non-conformities being created. The lot is completely <br /> conforming, and the front yard setback to Seaview will become a conforming condition. <br /> 1 <br />
