MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owners, Michael A. Flammini and Stacey D. Flammini <br /> 25 Overlook Knoll Road, Map 118 Parcel 34 <br /> Mashpee, MA 02649 <br /> SP-2023-45 <br /> The calculations were configured based on the neighboring property at 17 Overlook Knoll that is <br /> 15.5 ft. from Seaview, and the property at 21 Overlook Knoll Road is currently in the process of <br /> being built. The engineer treated this as a vacant lot because it is not completed yet, and there is <br /> no setback but is considered 25 ft. In this particular case the average setback is 20.25 ft., and is a <br /> conforming condition. The average proposed setback was calculated at 19 ft. The lot coverage is <br /> slightly decreasing from 24.5% to 24.2% and is still under the allowed 25%. The new structure <br /> will be building code compliant, and is consistent with what has been approved by the Board in <br /> the past in the same neighborhood. <br /> Mr. Robert Orsi, represented the Popponesset Beach Association stated that there were no <br /> objections to the project,but requested that the homeowner have a discussion with their contractors <br /> to not block the abutting driveways during construction. Mr. Orsi also requested that the proposed <br /> driveway on Overlook Knoll Road not be accessible onto Seaview Avenue. <br /> Mr. Bonvie stated that the Board can only recommend that the applicant has a conversation with <br /> their neighbors. <br /> Attorney Kirrane agreed to eliminate the driveway and requested that the Board not impose a <br /> condition to another meeting if the plans have changed other than the driveway. <br /> Chairman Bonvie stated that a condition can be made that the driveway will be removed from the <br /> Seaview Avenue side. <br /> Mr. Hauss a direct abutter,wanted to know the height and how the proposed structure is measured. <br /> He wanted to know the setbacks from the front and the proposed wall. He also asked what would <br /> be in place of the driveway. <br /> Mr. Morris said that the proposed dwelling height is 29 ft. 7-5/8 in. and is measured by the average <br /> natural grade as stated in the bylaws. <br /> Mr. Braney said that the wall can be removed. <br /> Attorney Kirrane said that natural vegetation will be in place of the driveway,and agreed to remove <br /> the wall from the plan. <br /> There were no more comments from the Board or audience. <br /> 2 <br />
