The Project shall be phased over a five year period as follows; <br /> Multi-Familv Single Family <br /> Year 1 14 units Optional but no more than 36 per year. <br /> Year 2 143 units <br /> Year 3 143 units <br /> Year 4 143 units <br /> Year 5 143 units <br /> 16. Upon information and belief,construction on the golf course began within two <br /> years after the issuance of the Special Permit) By 1980, the front nine holes of the golf course <br /> were opened for play. <br /> 17. However,the Project's progress on residential development faced a series of <br /> setbacks. From 1978 through 1980,the Property was entangled in a land dispute with the <br /> Wampanoag Tribe. Additionally,the recession of 1980 limited the then owner's ability to move <br /> forward with the construction of the residential component of the Project. <br /> The 1980 Modification <br /> 18. Accordingly,J.R.U. Realty,Inc., the then-owner of the Property and the Trust's <br /> predecessor-in-title, applied to the Board for an extension and revision of the Special Permit. At <br /> the public hearings to consider J.R.U. Realty,Inc.'s request for an extension and revision of the <br /> Special Permit, the Board focused on identifying a reasonable date for the completion of the <br /> phased development of the condominium units. A true and correct copy of an excerpt of the <br /> meeting minutes from the February 20, 1980 public hearing are attached here as Exhibit C. <br /> 19. By decision dated March 14, 1980,the Board modified the Special Permit to <br /> allow for 232 single-family units, as opposed to the originally allowed 178 (the"1980 <br /> Modification'). The Board stated that this modification was"in the best interest of the <br /> Per condition No.4 of the Special Permit,the golf course and clubhouse were a part of Phase I of the Project. <br /> 5 <br />
