It is recon-imended the Select Board erq-age in a public workshop process to ensure this <br />regalation has defined.oM a shared. set - goals for asn a wa .lhpee in the commmity can broadly support. <br />Mike Richardson, Slice Way, and President of the Peninsula Council was in attendance with additional <br />representation to positively request the Select Board get involved and help the communities they represent. <br />Regulation 25 is noted to be in the review process with the Conservation Conirnission and with the DER With <br />the wide impact of this regulation, it is recommended that other boards, committees, commissions be involved in <br />a.forrnal engagement process. This would include the Waterways Commission, Harbor Managen. ient, Zoning <br />Board of Appeals, and Planifing Board. <br />How -ever, there is concern regarding precedent and the procedures for amending Bylaw regulations under <br />Mashpee's Home Rule Charter. As stated.,;.After Conservation Commission consensus on the final draft <br />revisions, the draft is sent to'row n Counsel. There is feedback at Public Meetings, and edits are incorporated <br />into the final draft. After legal review Public Hearings for public comment are scheduled. After all public <br />comment and legal review, the Conservation Commission detertnines the date of the revised regulation to the <br />public, etc. <br />.Mr. Richardson indicated the Popponesset Island Association, the Working Group and Peninsula Council have <br />all contacted the Conservation Commission requesting to participate in discussions regarding llegulation 25, but <br />were met with resistance. There have also been several efforts to discuss this with the Select Board with the <br />premise to work through. a process where everyone is able participate. The result has been the sarrie. <br />John Mall(yy, Co-chair of the Popponesset Working Group and a member of'Save Popponesset Bay indicated <br />willi the rise in sea level and other environmental factors there is a need to have a well th. ought out Regulation <br />25. Mr. Malloy stated fl-we regulation is complex and hiniting to hotneowners, it is a process that would forever <br />change the Town. of Mashpee. The rules would reduce the number of homes slated for reconstruction <br />encouraging residents to leave the community,, For some there would be reduced property values which would <br />create reduced fliture tax revenue, and reduced.FEMA manies for the Town. Mr. Malloy indicated the groups <br />have asked the Conservation Commission to hold a workshop session allowing for engagement in discussions, <br />and have asked ifthe amenchuents can be deferred until DEPlias approved the process. It was noted that other <br />departments have welcomed (he working groups, and discussionshave been very productive. <br />
