16 Great Necks Road North <br />.Mashpee, Aassachusetts 02649 <br />Carlos Hanzi from Evolution Developments, LLC is present. He does not live there, he is from <br />Ashland, MA. On November 2, 2022, this Board voted to take a bond for the street where he <br />built 8 homes on Casper Circle. He submitted the as built to the Board and they are finished. <br />He requests the Board release the bond of $58,500. In talking with Mr. Pesce, the plan was <br />reviewed and accepted by Mr. Pesce an hour ago. <br />Mr. Fudala noted the $58,500, but there was another $5,014 that was set aside to pay for Mr. <br />Pesce for Casper Circle. A registered letter needs to be signed off by Town Clerk, Consulting <br />Engineer, and Planning Board. <br />MOTION: <br />Mr. Balzarini made a motion on the condition the applicant submits a certified <br />written statement that says construction or installation secured by the <br />performance guarantee has been completed in accordance with subdivision rules <br />and regulations titled the statement of completion, and the Planning Board <br />authorizes the release of $58,500 surety and any interest accrued related to the <br />Casper Circle subdivision. Seconded by Ms. Faulkner. All in favor. <br />Blue Castle Drive — Letter to Laurent from Ockway Highlands residents <br />There was a letter dated August 20, 2024 addressed from Ockway Highlands to Catherine <br />Laurent, DPW Director about the condition of Blue Castle Drive. Included are pictures, a <br />petition, and an e-mail titled "Dilapidated portion please help" dated August 27, 2024 from <br />Kenneth Roth. All 10 residents signed the petition. <br />The current state of Blue Castle Drive is unacceptable, unfit for travel, and is due for help. The <br />special permit conditions are from 6/11/2014 with a modification in 2018. The then Consulting <br />Board Engineer determined the road had not been maintained as required. The included <br />photos were taken August 17, 2024. The developer was not required to pave the entirety of the <br />road. It is the primary emergency access to homes in that development. In the sales <br />agreement it was noted the entire Blue Castle Drive would be paved beginning at the entrance. <br />The residents feel it should be paved. They have a $60,000 estimate for paving. <br />Timothy Dorsey- He is a resident of Blue Castle Drive, and he agrees with this letter. He <br />inquired about the $100,000 bond being released when many special permit conditions have <br />not been met. It took 9 years to get 2 signs. There was no stop sign or mechanical speed <br />caution sign at the intersection of Degrass Road and Carriage Road. <br />Ms. Waygan stated the tripartite agreement is complete. The agreement is posted in one of the <br />meeting packets. The Developer complied with that agreement. The tripartite did not cover <br />every special condition. If there is a condition that has not been met and you need it enforced, <br />that is through the Building Commissioner. Ed Pesce has visited, and the Board sent him out <br />there spending the town's money to help resolve this issue. <br />3 <br />
