16 Great Necks Road North <br />Mashpee, Massachusetts 02649 <br />Ms. Faulkner recalls Mr. Morin fixing the road some months ago. It continues to degrade and <br />will require repairs until it is repaved. <br />Mr. Fudala commented the condition would be in the hands of the HOA and Mr. Morin <br />oversees that Association. <br />Ms. Waygan noted the e-mail to the DPW Director was also sent to Ed Pesce on August 27, <br />2024. She does not think he has responded to that yet. When he is back from overseas, he will <br />address that e-mail. <br />Mr. Fudala stated the mechanical speed sign was not required to remain on that street the <br />entire time. The Town Manager used funds to purchase a larger mechanical sign. The signs <br />move around town. <br />Mr. Dorsey does not understand why funds from the Ockway Highlands subdivision were used <br />to purchase a speed limit sign to put somewhere else in town. For 14 months every resident of <br />Blue Castle Drive came here complaining. A concession was the mechanical speed limit sign <br />and a three way stop sign at the intersection of Carriage road and Degrass Road. He can bring <br />in written affidavits. He will be making a public records request for the special permit, tripartite <br />agreement, and any associated documentation. <br />Ms. Waygan instructed him to only ask for what he needs, it may require a surcharge as that is <br />a lengthy list of documents. <br />Ms. Faulkner stated the issue of the unpaved road was not a condition. Mr. Dorsey stated the <br />petition quotes actual verbiage to back up their claims. <br />Ms. Waygan called order. They will review the documentation that Tom Fudala provided. They <br />cannot see a way that the Planning Board has jurisdiction over this. It was not a condition of <br />the special permit. She will send this all to the Consulting Engineer. He has tons of reports he <br />compiled on this matter. She will look at it again but does not think this falls under their <br />jurisdiction. <br />Mr. Fudala elaborated that the Planning Board's decision was never appealed in that 20-day <br />appeal period, its done. They cannot go back UNLESS the person who owns the special <br />permit comes forth to petition for a modification. The time to appeal to a judge has lapsed. <br />Ms. Waygan asked that this item remain on the agenda until Ed Pesce has a chance to review. <br />CHAIR'S REPORT <br />Report on Chair's Activities <br />Ms. Waygan emailed the Cape Cod Commission, and they have received the draft of the LCP. <br />They are providing comments about the draft meeting standards within 30 days. <br />Planning Department Staff <br />91 <br />
