MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> November 13, 2024 <br /> Attorney Kirrane stated that the hot tub is not connected to the septic, and <br /> believes his client is removing it. <br /> Mr. Furbush asked if the garage can be moved back 3 ft. Attorney Kirrane said <br /> that it's a uniquely shaped lot. <br /> Mr. Dehelean believes that if the garage is moved back it will be too close to the <br /> shed. <br /> Mr. Goldstein said that it would be more of a challenge to move the garage back, <br /> and believes the shape of the lot is a hardship. <br /> Attorney Kirrane determines that if a lot fronts two roads, there are two rear <br /> setbacks and no side yard setbacks. <br /> Mr. Morris said that he has no issues with the garage being flush. <br /> Ms. Susan Regan, a direct abutter addressed the Board and is in favor of the <br /> project. <br /> Ms. Lynn Barbee addressed the Board and is in favor of the project. <br /> Chairman Bonvie asked for a motion to close the public hearing. Mr. Furbush <br /> made a motion to close the public hearing. Ms. Sangeleer second. All were in <br /> favor. <br /> Chairman Bonvie asked for a motion for the application. <br /> Mr. Reidy made a motion that the Board issue a Written Finding to Owners, <br /> Daniel G. Kirkland and Deborah A. Kirkland, Trustees of the Kirkland 2014 <br /> Family Trust under §174-17 of the Zoning Bylaws to raze a single car garage, <br /> and replace it with a new two-car garage attached to an existing single-family <br /> dwelling on property located in an R-3, and Seabrook Village Cluster <br /> Subdivision, Map 102, Parcel 1, Mashpee, MA with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a <br /> Written Finding under Mass General Law 40A Section 6. <br /> 2. Site Plan - Prepared for: Kirkland 2014 Family Trust, Daniel 8v Deborah <br /> Kirkland, 125 Surf Drive. Date: May 31, 2024, Drawn by: MD, Checked <br /> by: MC.
