Conditioned on all Town Department comments read into the record <br /> including but not limited to the Board of Health, and specifically related <br /> that the change of foot print requires a Title 5 inspection. The storage area <br /> above the garage is not fit for human habitation and is not a bedroom. The <br /> tank is 40-plus year old and should not have a hot tub on it. <br /> S. Any changes to the plans will require the applicant to return to this Board. <br /> 6. Conditioned that the applicant seek and obtain the Building Department <br /> review in reference to the Tree Bylaw Chapter 175 of the Town Bylaws prior <br /> to the application of a building permit. <br /> 7. The Board finds under §174-17 that the proposed project is not <br /> substantially more detrimental than the pre-existing, nonconforming <br /> structure or use to either the Town or the neighborhood. <br /> Ms. Sangeleer, second, yes. <br /> Mr. Goldstein, yes, <br /> Mr. Furbush, yes, <br /> Mr. Blaisdell, yes, <br /> Chairman Bonvie, yes. <br /> All were in favor to issue a Written Finding. <br /> 24 Seconsett Point Road: Owners, Joshua and Nicole Delman request a <br /> Variance under §174-31 (Land Space Requirements), and §174-33 (Setback to <br /> wetlands) of the Zoning Bylaws to vary the front, side and rear setbacks, lot size, <br /> and frontage requirements to allow for construction of a single-family residence <br /> on property located in an R-3 Zoning District, Map 124, Parcel 35, Mashpee, MA. <br /> Attorney Christopher Kirrane representing the applicants for this Variance <br /> request. He is requesting a continuance. The project was recently approved by <br /> the Conservation Commission but has necessitated a change in the plans that <br /> were originally submitted to this Board. He is requesting a continuance until <br /> December 11, 2024. The application only involves seeking a Variance for lot <br /> coverage and setback to wetlands. There is no relief request for front, side or rear <br /> yard setbacks, only lot coverage. The lot is completely in the flood zone. <br /> 8 <br />
