MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> November 13, 2024 <br /> Attorney Michael Schulz represented the homeowner's request for a Written <br /> Finding under Section 174-17 and 174-33 to allow for the existing dwelling to be <br /> raised out of the AE flood zone. Also present was Chuck Rowland, Engineer with <br /> Cape & Islands Engineering. The existing property is pre-existing nonconforming <br /> with respect to lot area at 15,901 sq. ft. where 40, 000 is required. The lot <br /> coverage is nonconforming at 100% because it is entirely in the flood zone. The <br /> side yard setback is nonconforming from the existing deck at 11 ft. where 15 ft. <br /> is required. The property was developed in 1985 as shown on the site plan <br /> prepared by Cape & Islands Engineering. <br /> The project includes raising the existing dwelling to comply with FEMA <br /> requirements. The first floor elevation will be raised from 11.6 ft. to 14.1 ft. on <br /> the existing foundation. There will be flood vents installed, and a single-car <br /> garage on grade with flood vents, and a kitchen and family room addition <br /> constructed on piers. This proposed work will be approximately 640 sq. ft. and <br /> will comply with all setbacks. This project was approved by the Conservation <br /> Commission on October 24, 2024. <br /> Mr. Reidy read the Conservation Department comments dated October 28, <br /> 2024 into the record; "Resource Areas: LSCSF& Buffer zone to Salt Marsh - NOI <br /> application was approved unanimously with the condition of a two year <br /> mitigation & monitoring contract with a certified professional. With the <br /> installation of multiple drywells to control roof runoff, installation of multiple flood <br /> vents, reduction of driveway area, and conversion of driveway area to native <br /> planting beds will enhance resource areas natural function." <br /> Mr. Reidy read the Board of Health comments dated November 6, 2024 into the <br /> record; "House to remain 4 bedroom, 1 on the first floor and 3 on the second floor." <br /> Mr. Goldstein mentioned that the height of the structure should be noted on the <br /> plan. Mr. Rowland said it will be raised to 14.1 ft. <br /> Chairman Bonvie asked the Attorney if there are any new nonconformities being <br /> created. Mr. Schulz said; no, there will be an improvement with the side yard <br /> setback. <br /> Mr. Reidy asked about the smart vent and its purpose. Mr. Rowland said that <br /> it's a flood vent, and its purpose is to open and close without human <br /> intervention. It has foam, and if a storm event happens it floats from a hinge up <br /> from the water pushing, and will flush out the water to prevent buildup of any <br /> hydrostatic pressure of the foundation inside the house. <br /> 4 <br />
