MEETING MINUTES DECEMBER 11, 2024 MASHPEE ZONING BOARD OF APPEALS Chairman Bonvie asked if the Board would be willing to amend the motion. Mr. Reidy read the amended motion to the Board to give the Board the ability to determine a decision only on condition #6, and will not revoke the Certificate of Occupancy. "That the Zoning Board of Appeals has determined to uphold the Building Commissioner's Decision regarding his enforcement jurisdiction with respect to condition#6 of the Zoning Board of Appeal Decision (SP-2022-29)for the property located at 68 Mercantile Way, Map 88, Parcel 91, Mashpee, MA. Mr. Furbush made a motion to close the public hearing. Chairman Bonvie said there's a motion to close the public hearing. Mr. Blaisdell second. All were in favor. Chairman Bonvie communicated to the Board that a "yes" vote, the Board is upholding the Building Commissioner's Decision. A "no" vote would be in favor of Mr. Clapper's appeal the trees are not planted correctly. Mr. Reidy stated he made his motion. Mr. Blaisdell, second. Chairman Bonvie took a roll call vote; Mr. Milbury, no, Mr. Furbush, no, Mr. Furbush, no, Mr. Bonvie, no, and Mr. Goldstein, no. Mr. Reidy wanted to confirm that the Building Commissioner has to determine what needs to be done to make sure that the Owner complies with condition #6. The Board agreed. Mr. Morris asked the Board who will give him the authority. Mr. Furbush said; the Board just gave you permission. Chairman Bonvie stated that he would hope that the person who built the building will plant the trees 8 ft. on center, if there's a tree there, 8 ft. on center. OTHER BUSINESS ➢ Approve November 13, 2024 Meeting Minutes. Mr. Bonvie asked for a motion to approve the minutes. Mr. Furbush so moved. Mr. Blaisdell, second. All were in favor. ➢ Approve Pesce Engineering Invoice dated November 21, 2024 for Mashpee Commons peer review 40B Project. 16
