MEETING MINUTES <br /> DECEMBER 11, 2024 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Mr. Bonvie wants a document submitted by the Acting Fire Chief that he has <br /> addressed the access concerns, and that he is satisfied that the access issues <br /> have been addressed by the homeowner. <br /> Attorney Kirrane responded that this project doesn't require variances. He told <br /> the Board he will schedule a date with the Acting Fire Chief to discuss his issues <br /> and will report back to the Board. He asked for a continuance to extend the <br /> hearing until January 8, 2024. <br /> Mr. Bonvie asked for a motion to accept the extension until January 8, 2024. <br /> Mr. Caggiano, so moved. Mr. Furbush second. All were in favor. <br /> 68 Mercantile Way <br /> The four regular members and Associate Mike Milbury. <br /> Chairman Bonvie addressed the Board and read Condition 6 of the Special <br /> Permit that was issued by the Board back on July 27, 2022. <br /> Mr. Eric Clapper at 10 Sugar Pine Circle presented his appeal petition and read <br /> his detailed presentation to the Board. In summarizing, he argued that the <br /> Building Commissioner did not enforce the requirement of condition #6 of the <br /> Special Permit issued by the ZBA stating; "that the applicant install white pine <br /> trees 8 ft. apart, 8 ft. tall along the north boarder with the 10 ft. zone."He believes <br /> that the trees where not planted the entire length of the north boarder. He also <br /> argued that the lighting illuminating from the building is pouring onto his <br /> property, and that the dumpster is situated too close to his property that was <br /> not depicted on the original site plan. (Note: There is a dumpster depicted on the <br /> approved 2022 site plan). <br /> Ms. Jeanne Clapper at 10 Sugar Pine Circle presented her appeal petition and <br /> read her detailed written presentation to the Board. She argued the same issues <br /> as her husband. <br /> The Board reviewed the approved 2022 site plan during the presentation from <br /> the applicants. <br /> Mr. Stephen Bernard, 7 Sugar Pine Circle addressed the Board and agreed that <br /> condition #6 was not adhered to by the owner. He believes that the Board can <br /> agree that the Building Commissioner did not support the agreement of condition <br /> #6 of the Special Permit. <br /> 15 <br />
