MEETING MINUTES <br /> DECEMBER 11, 2024 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Mr. Bonvie is more concerned with the fire protection issue, and the comments <br /> from the Acting Fire Chief. He is less concerned with the leach field. He suggested <br /> that maybe there needs to be some improvement made to provide sufficient road <br /> access. <br /> Mr. Morris mentioned that the access runs through lot 18 and lot 19. Is this a <br /> legal right of way? Attorney Kirrane believes that the access is through <br /> Monomoscoy Road and Pine Ridge Road. He said that Mr. Borselli, Engineer with <br /> Falmouth Engineering provided a plan that shows differently. <br /> Mr. Morris stated that there is an obligation that this road would need to be <br /> cleared 16 ft. from 150 ft. from the furthest structure, and it looks like its 10 ft. <br /> This is up to the responsibility of the homeowners. <br /> Mr. Furbush what the front setback is on the existing house. The existing site <br /> plan depicts 22.9 ft. from the road and on the proposed depicts 11 ft. The <br /> proposed house doesn't have a clear setback dimension on the site plan. He <br /> thought maybe this is the question from the Acting Fire Chief. <br /> Mr. Milbury and Mr. Reidy do not have an issue because there is an existing <br /> structure and there's no changes to the road. They questioned why the Fire <br /> Department has an issue now. <br /> Mr. Bonvie stated that the existing house may have been built before zoning. <br /> Mr. Morris said that he noticed that the road needs an all-weather surface for <br /> fire apparatus, a width of 12 ft. and a cleared width of 16 ft. This right-of way <br /> should be maintained by the owners. It needs to conform to the bylaw §174-32. <br /> Mr. Mike Ciampi of 9 Pine Ridge Road discussed his concerns with the project <br /> that dates back to 2016. He has concerns regarding the leach field being built <br /> too close to his property, and does not believe the owners of 17 Monomoscoy own <br /> the road. <br /> Mr. Briar St. John said he reached out to emergencies services. He understands <br /> that he is responsible for clearing the right-of-way if it's required to widen the <br /> road. He wanted to know if there were any other issues to address. He also <br /> mentioned he reached out to his neighbors regarding his project. <br /> 14 <br />
