MEETING MINUTES <br /> DECEMBER 11, 2024 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> The height of the new dwelling is 32.5 ft. Attorney Kirrane suggested that this <br /> project is similar to other projects that the Board has approved in the past, and <br /> is not substantially more detrimental to other dwellings in the neighborhood. <br /> Mr. Reidy read a letter dated December 3, 2024 from Diane Dineen, at 7 Pine <br /> Ridge Road into the record who supports the project. <br /> Mr. Reidy read the Conservation Department comments into the record dated <br /> December 2, 2024; "Resource Areas: LSCSF, Buffer zone to Salt Marsh, Area of <br /> Ecological Critical Concern (ACEC), & Buffer zone to Bordering Vegetated Wetland <br /> (BVW) - Notice of Intent application for raze and replace of dwelling with attached <br /> garage, IA septic, drywells, mitigation plantings, and restoration plantings. <br /> Remand of NOI was approved unanimously due to a waiver of regulations request <br /> for LSCSF performance standards. Concerns over vertical walls in LSCSF was <br /> satisfied with waiver request and the amount of native plantings going in place as <br /> well enhanced protection to native vegetation during construction." <br /> Mr. Reidy read the Board of Health comments into the record dated December <br /> 6, 2024; "House is 5 bedroom. 1 on the first floor, 3 on the second floor and 1 <br /> above the Garage area. Septic is designed for 5 bedroom with Nitrogen removal <br /> technology. Health Department does not enforce the under road utilities. Nothing <br /> is to be built above the leaching field." <br /> Mr. Reidy read a letter from the abutter Michael Ciampi into the record dated <br /> December 2, 2024, and noted there is 20 pages of correspondence attached. <br /> Mr. Reidy read the letter from Acting Fire Chief, Joe Peltier date December 9, <br /> 2024. <br /> Mr. Reidy read Attorney Kirrane's comments and letter into the record with <br /> attachments. <br /> Mr. Reidy read the Building Commissioner's comments into the record; <br /> Mr. Furbush asked Mr. Morris if a septic system considered a structure. <br /> Attorney Kirrane mentioned that the leaching system is located on the lot across <br /> from the subject lot. He read the definition of a structure. <br /> Mr. Morris stated that this lot is not buildable. <br /> Mr. Reidy re-read the BOH comments to the Board. <br /> 13 <br />
