MEETING MINUTES
DECEMBER 11, 2024
MASHPEE ZONING BOARD OF APPEALS
Mr. Bonvie asked for Board questions. Mr. Ganzenmuller asked where the
current septic system is located.
Attorney Kirrane addressed the question that there is currently a cesspool on
that lot which is an untreated hole in the ground. The new septic system is a
substantial improvement.
Mr. Bonvie asked if the garage door becomes 8 ft. will the ridge of the house be
lowered 2 ft. Mr. Cook said; yes.
Mr. Morris believes that the offer of lowering the size of the door is a lot better.
Mr. Bonvie explained to Ms. Cassanelli that the applicant has agreed to lower
the height of the garage door, and the ridge of the dwelling. As one member of
the Board, he is a lot more comfortable to agree that this change is less
detrimental.
Mr. Reidy wanted to review the conditions if a motion is made. There are two sets
of conditions relative to the height of the garage door, and the ridge of the house.
There is also the condition of the use of the garage area to be used by the resident
of the home.
Ms. Wood spoke and agrees that she is less concerned that the proposal has
changed to lower the house 2 ft. and the garage to 8 ft. The house will be 22 ft.
tall.
Mr. Morris asked Mr. Bonvie if the Board could accept the changes to the plans
to be approved administratively when submitting the building permit. Mr. Bonvie
agreed.
Mr. Bonvie asked for a motion to close the public hearing. Mr. Blaisdell so moved.
Mr. Ganzenmuller second. All were in favor.
Mr. Bonvie asked for a motion for the public hearing.
Mr. Reidy made a motion that the Board issue a Special Permit under §174-17.1
and §174-33 of the Zoning Bylaws to Owner, Martin J. Reilly at 15 Childs Road,
Mashpee, MA with the following conditions:
1. The Board has determined that the applicant meets all the conditions of a
Special Permit under Mass General Law 40A Section 9.
5
