MINUTES - BOARD OF HEALTH MEETING, JULY 13, 1989 page 4. UNSCHEDULED APPOINTMENT - TOM FUDALA - SPECIAL PERMIT AUTHORITY As you know, Mr. Fudala stated, the Planning Board requires monitoring wells for condo and single family subdivisions. We are interested especially in monitoring wells around treatment plants. We want to require a permanent monitoring program of these wells and want them located both up- and downstream of the treatment plant. Our re- quirements will be similar but more extensive than the requirements of DEQE. Mr. Greelish questioned what the longterm provisions would be to continue this monitoring. Mr. Fudala handed over two water quality reports, one for Quashnet Wopds and one for Watersedge. In condo projects one method would be to establish an endowment, the other would be to establish a town donation fund account. The developpers objected to having to put so much money up front. They and the Planning Board agreed to establish as part of their capital reserve fund an amount of money earmarked for the monitoring program. Furthermore the Planning Board through its special permit autho- rity is requiring that the licensed treatment plant operator be held liable for the performance of the monitoring program. The reason being that if he' s responsible he' ll charge the developper up front for this extra duty. He continued to state that after a lot of research and talking to Mr. Butler from BCHED he has come up with more stringent water quality standards than the DEQE requires. The authority of the Planning Board goes beyong that of the DEQE in their Discharge Permit and that of the Board of Health in their permitting autho- rity. The Planning Board does not want to be told that DEQE approved my treatment plant so you must also. He stated that he does not trust DEQE todo the complete ob. The monitorin program will be in effect at infinitum. It calls for a monthly .sionitoring program for a more extensive list of parameters to be tested for than that required in the DEQE discharge permit; it also calls for a certain number of monitoring wells up and downstream of the plant and some off site in projected plume areas. The developper would be responsible for obtaining easements for off site wells. (If not obtainable for less than $100 the Board would allow relocation or drop the requirement of that well ) . Mr. Costa questioned whether the Planning Board has all these powers. Mr. Fudala stated yes, under the special permit authority, to protect the public health. The Planning Board feels that they do. These documents essentially call for the Board of Health to be a participant in this process. I did speak to Mr. McQuaid to get copies of water quality standards.But this is "my little baby" that I 've been working on. It calls for copies of all these reports to be given to the BOH. In fact the BOH will have to sign off on these documents as well as the Planning Board and the local water resource manager, who I happen to be. This is a standard monitoring program which will apply to all treatment plants. Only section 12 changes from one to the other and that deals with the number and loc- ation of the wells. The enforcement will be through the Planning Board and the Building Inspector' s office. Mr. Greelish informed Mr. Fudala of his plans to generate a water quality map of the town. This will incorporate the water tests we get back and results of the monitoring wells. . This will generate a computer map. Mr. McQuaid questioned how much of this is duplicating what DEQE requires and how much is going beyond that. More constituents will be analysed than what DEQE requires, he said.A new and less expensive method of analyzing VOC' s is being looked into at the County Lab. With this cheap test I am calling for a VOC test monthly.
