MASHPEE ZONING BOARD OF APPEALS <br /> MARCH 23,2016 <br /> MINUTES <br /> 23 Cordwood Road: Applicant requesting discussion of recently approved Variance for <br /> extending the existing garage. <br /> On March 9, 2016, the Board heard the petition of Mr. Mullen, on behalf of the owner, to <br /> add an addition to a free standing garage, which was approved, with conditions. Mr. <br /> Mullen, was now before the Board to see if the removal of the garage was in-line with the <br /> approval granted at the original hearing or would he need to re-apply. <br /> Mr.Mullen said he is requesting a couple of options,either to keep one wall of the structure <br /> and demo the remaining walls and roof, or raise the existing structure,remove the existing <br /> cinderblock foundation, and install a new cement foundation. He wanted to know his <br /> options. <br /> Mr. Mendoza said he had a previous discussion with Mr. Mullen who wanted to know if <br /> he could raze the existing structure, but that was not what he presented to the Board. Mr. <br /> Mendoza said there was a chance that he would have to re-apply to the Zoning Board. <br /> Mr.Mendoza spoke to the Board of Health,and asked them if the proximity of the structure <br /> would be too close to the septic and leaching field if the entire structure was razed and <br /> moved to make the lot more conforming to Zoning. He was told that as long as the structure <br /> is re-built 10 feet away from the septic system, and the new wall that faces the leaching <br /> field has a rubber membrane attached.This option would not require a formal meeting with <br /> the Board of Health and can be approved by an agent in the Board of Health office. Mr. <br /> Mendoza said this would be a better option because it would meet the Zoning setbacks. <br /> The Board told Mr. Mullen it would be a good idea to install the plantings and keep the <br /> abutters happy. <br /> The Board questioned whether a raze and replace project required Zoning Board approval. <br /> Mr. Mendoza said not if the project conforms to the required setbacks and the lot becomes <br /> conforming. <br /> Mr. Mullen said he will have Cape & Islands reconfigure the plan and will see the Board <br /> of Health. If Mr. Mullen decides to demo the structure, and does not move it then it's <br /> considered a modification, and will need to refile with the Zoning Board. They said if he <br /> decides to move it toward the property line so it's within 15 feet, he does not need to <br /> reapply to the Zoning Board but requires Board of Health approval. <br /> 4 <br />
