MEETING MINUTES <br /> JANUARY 8, 2025 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Mr. Milbury asked Attorney Kirrane if the A.M. Wilson photo depicted the access of <br /> the parcel. Attorney Kirrane said that is the road access to his client's property. <br /> Mr. Bonvie asked to review the letter submitted by Sundial Farms dated December <br /> 7, 2024, specifically the second paragraph referencing Chapter 183 Section 58 the <br /> legal presumption of ways and the rights to use the ways. <br /> Attorney Kirrane said his client has a deed from his father. The Board's opinion that <br /> his client has right of passage to Ned Besse Road. <br /> Mr. Bonvie mentioned that an NOI was submitted and approved by the Conservation <br /> Commission. <br /> Mr. Furbush confirmed that the issues raised by the abutter were addressed by the <br /> Board. <br /> Ms. Barbara Nichols is an abutter and addressed the Board stating she has been a <br /> resident for 84 years and agreed that the road is accessible. <br /> Ms. Arlene Wilson addressed the Board and represented the Daniel's property, and <br /> asked to respond to the points that the Board reviewed in her letter. First, she <br /> mentioned that she believes the existing driveway is imperious, and will present <br /> issues for the new construction. Second, she believes that there will be trees removed <br /> for the trucks to have access to the property. She believes that the abutters should <br /> have been notified of this process. Third, she mentioned that the plan that was <br /> submitted to the Zoning Board, dated January 3, 2025 was not approved by the <br /> Conservation Commission. <br /> Mr. Bonvie stated that it is not the Board's position whether the homeowner can or <br /> cannot provide access to his property. Mr. Bonvie commented that the Board <br /> conditions any changes to the plan will require the applicant to return to this Board. <br /> The applicant will have to consult with the Conservation Department to confirm that <br /> the plan is the same that is in front of the Zoning Board at this time. <br /> There were no more comments from the audience or Board. Mr. Bonvie asked for a <br /> motion to close the public hearing. Mr. Furbush made a motion to close the public <br /> hearing. Ms. Sangeleer, second. All were in favor. <br /> 5 <br />
