MEETING MINUTES <br /> JANUARY 8, 2025 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Mr. Bonvie mentioned that the Building Commissioner will have to confirm that the <br /> property has appropriate frontage. <br /> Mr. Morris mentioned that Jones Road and the camp ground has been abandoned, <br /> and Ned Besse is a road, and cannot be reinstated as a camp ground. Mr. Morris <br /> has concerns with the building height. The average original grade is 68.99 ft., and <br /> the 50% story elevation is 68.90 ft. which is 9-100ths of a foot difference. The plan <br /> depicts the basement below the average grade as 51% which could be a potential <br /> issue as a third story which is not allowed under the bylaw. He would require a <br /> certified elevation/foundation letter from the engineer. <br /> Mr. Wallace stated that a letter will be submitted noting the foundation elevation. <br /> Mr. Bonvie stated that it's not just the foundation, it's the actual finished frame will <br /> also have to be certified. <br /> The Board has concerns with the Building Commissioner's statements. <br /> Attorney Kirrane believes that an elevation certificate is required prior to submitting <br /> a building permit. <br /> Mr. Morris mentioned he is concerned that this elevation is at 50%, and needs to be <br /> below the 50%. He needs to be reassured that this will not be at 50%. He would like <br /> a certified letter submitted before the house is delivered. He said he can accept this <br /> as a condition that a certified letter be submitted for the foundation. <br /> Mr. Bonvie mentioned that the Board can condition a certified letter be submitted <br /> for the foundation before the house is delivered confirming that the height and the <br /> foundation is under 50%, and not considered a third story. <br /> Mr. Goldstein asked if the ridge should be included. Mr. Morris said no because the <br /> ridge is 29 ft. There's no discrepancy. <br /> Mr. Furbush asked if the plan needs to be accurate for the Board to approve it. Mr. <br /> Morris said that he doesn't think it needs to be revised, however, he requires the <br /> foundation to be lower than a full percentage point, not a fraction thereto. <br /> Mr. Wallace admitted that the height is 51%. <br /> Mr. Furbush asked Attorney Kirrane to address and review all the points from the <br /> A.M. Wilson letter dated January 8, 2025. The Board continued and addressed all <br /> those points. <br /> 4 <br />
