MEETING MINUTES <br /> JANUARY 8, 2025 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> 17 Monomoscoy Road West: Owners, Biria D. and Elaina C. St. John, Trustees of <br /> the Biria St. John Trust request a Special Permit under §174-17.1 and §174-33 of <br /> the Zoning Bylaws to raze a pre-existing, nonconforming single-family residential <br /> structure and replace it with a new single-family residential structure on property <br /> located in an R-3 Zoning District, Map 114, Parcel 20, Mashpee, MA. (Continued <br /> from 12111124 hearings). <br /> Attorney Kirrane represented the homeowners. Also present was the homeowner, <br /> Ms. St. John, and Mike Borselli, Engineer with Falmouth Engineering. At the last <br /> meeting on December 11, 2024, the Board had a concern with the narrow area of <br /> the road, and wanted comments from the Fire Chief regarding emergency access. <br /> Attorney Kirrane reached out to the Fire Chief. Consequently, Attorney Kirrane, Mr. <br /> Borselli, the homeowner, and Building Commissioner met with the Fire Chief at the <br /> site. <br /> Attorney Kirrane provided a revised site plan that depicts the measurements <br /> required under the bylaw §174-32 Fire Protection. A measurement was taken from <br /> the furthest point of any structure of the access, and measured 150 ft., and at the <br /> 150 ft. point has a width of 16 ft., and complies. <br /> Mr. Ganzenmuller read a letter submitted by the Fire Chief into the record dated <br /> December 19, 2024. "I met with the Building Commissioner, the owner, her engineer, <br /> and her lawyer at the address mentioned above. We walked through the area to <br /> address the fire department's needs. After the meeting, I believe that all issues were <br /> resolved, and a new plan will be submitted reflecting these changes." <br /> Mr. Furbush read the Building Commissioner comments into the record dated <br /> January 8, 2025. "For 17 Monomoscoy, the Chief does mention in the letter regarding <br /> that he understands that there will be changes made in the plan to illustrate to the <br /> Board compliance to 174-32. His and my concerns were satisfied at the site visit. Not <br /> a perfect scenario but enough." <br /> Mr. Furbush read Attorney Kirrane's letter dated December 30, 2024 into the record. <br /> "Attached are the revised existing and proposed conditions plans for 17 Monomoscoy <br /> Road West. These plans were updated to show the 150' distance from the furthest <br /> corner of the new structure to show compliance with the bylaw. I have copied David <br /> and Chief Peltier on this email so that they both have the opportunity to review the <br /> revised plans. If I have missed anything or there are any further concerns, please let <br /> me know." <br />
