MEETING MINUTES <br /> JANUARY 8, 2025 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> Mr. Ganzenmuller read an abutter letter and attachments dated December 30, 2024 <br /> from Michael Ciampi into the record. He is concerned with access, his property being <br /> traversed, and that the tree bylaw is being ignored. <br /> Mr. Furbush asked Attorney Kirrane if a leach field considered a structure. Attorney <br /> Kirrane said, no. Mr. Goldstein does not agree that it is a structure because it is not <br /> considered as lot coverage. <br /> Mr. Morris confirmed Mr. Goldstein's comment that under the Zoning bylaws the <br /> leach field is not considered a structure, and is not counted as lot coverage. <br /> Ms. Sangeleer commented that as someone who has taught many classes on internet <br /> research, this statement is not a reliable source. <br /> Mr. Borselli addressed the Board and confirmed a definition of a "structure", and <br /> under the Zoning bylaw, and Title 5 is not a structure which is under the State <br /> sanitary code and local health regulations a septic system has to be 10 ft. from a <br /> property line. These systems are under ground, and cannot be considered a <br /> structure. <br /> Mr. Goldstein mentioned that a fire pit is a structure, but is not under zoning. <br /> Mr. Morris mentioned that the tree bylaw is being addressed with the Conservation <br /> Commission's order of conditions. Also, an exemption form can be submitted. He <br /> also mentioned that he had a conversation with Mr. Ciampi and the Fire Chief. Mr. <br /> Ciampi has a right to put a boulder on his property. Property access is not any <br /> concern or under the Zoning Board's purview. <br /> Mr. Bonvie asked Mr. Morris if the Fire Chief will have adequate access around this <br /> potentially placed boulder. Mr. Morris said the Fire Chief will have access. <br /> Mr. Goldstein stated that during the final building inspection, a fire inspection is <br /> performed, and I believe whoever performs the Fire Department Inspection will <br /> determine if there are any issues at that time. <br /> Mr. Bonvie asked for audience comments. There were none. Mr. Bonvie asked for <br /> further comments from the Board. <br /> Ms. Sangeleer said that if the Fire Chief is okay, she is okay. Mr. Goldstein agreed. <br /> There were no more comments. <br />
